How to Cancel Your Cell Phone Contract

What's the average penalty for breaking your cell phone contract?

  • Kiosks, which may appear to be service providers, can charge even more. Kiosks are 3rd party providers, not cell phone carriers. Additional early termination penalties from kiosks can be as high as $400 PER PHONE LINE
  • **Be VERY careful about buying cell phone service from a kiosk at a mall; they often add additional terms to the contract that make it even more expensive for you to get out of a contract (not including the sometimes contradictory return policies and trial periods.) We even received a complaint from a blind couple that had been sold a family pack of camera phones by a kiosk vendor. Promises, promises, promises, but as one UCAN consumer advocate likes to say, "If it ain't in writing, it ain't in the contract."

What if your service isn't as good as you expected -- will they let you out?

  • Yes, for around $175 PER PHONE LINE. Cell phone companies do not guarantee quality of service. AT&T explicity states in its Terms and Conditions, "AT&T does not guarantee availability of wireless network." Other providers have similar provisions.

How bad does the service have to be before they let you out?

  • In many ways, all that you are entitled to with a cell phone plan is a phone, working or not. Cell phone contracts may not be drafted to cheat you, but they ARE drafted to keep you! Cell phone companies spend upwards of $300 in marketing costs and subsidies to win each customer and they are going to make it as difficult as possible for you to switch to a competitor.
  • Make use of your trial period to test your phone EVERYWHERE you are going to use it, because it is the only chance you will get. Do not expect the quality of service to improve. If you are told reception will get better once the new tower is put up, find a different provider

Can a change in contract terms be used as grounds for cancellation?

  • Contracts vary, but most changes to your contract can provide grounds to get out. Almost any new fee or new charge is your opportunity to break the contract. Why? Because they can't change any part of the contract without your permission. But they do it all of the time because they know that you DON'T know that you can use that change as a basis for canceling your contract. Here are some recent examples:
  • Text message price changes (Cingular T-mobile)
  • Administrative charge increase (Verizon, from $0.40 to $0.70)
  • Increase in unpublished number fee (Might entitle a bundled AT&T customer to quit Cingular/AT&T wireless,or AT&T DSL)
  • Make sure the change/increase applies to you. Typically you need to get to a manager. Be sure to use the term "materially adverse" when referring to the change, and have notice of the change in hand as well as the relevant provisions of the contract. See our Sample Script.
  • Each carrier takes a different stance on what is materially adverse and who can get out. You usually only have a short time to claim a change as materially adverse. See our guide to "Material Adverse" Clauses in Cell Phone Contracts for more info.

How good are those new websites that allow you to sell the remainder of your cell phone contract to someone else?

  • The concept has been around for a number of years. Most of the carriers have a process that allows you to transfer your contract, which can help to avoid activation fees, or perhaps find a deal. The contract "swapping" sites are OK for Plan B, but clearly the better option is to get out of the contract entirely. See a list of carrier activation fees. Available services include Cellswapper, Celltradeusa, and Resellular. Here is a short list of drawbacks:
  • There are a lot of outlandish sales to be found like $4/month plans and $5000/month plans.
  • Typical internet field of potentially sketchy anonymous buyers.
  • Not usually an instant process, can take up to 7 days, and buyer must pass a credit check.
  • Cost of plans do not generally differ widely from carriers' rates
  • Still a relatively little used process after many years of the concept being around

Are there any other ways I can get out of my contract? I'm desperate.

  • We've heard some pretty ridiculous contract cancellation stories and we thought we'd share a few for entertainment purposes. The following tips are not guaranteed to get you out of your contract, nor are they guaranteed to be legal.
  • Set your phone to "roam only." Instead of utilizing its own network, the phone will search for the networks of other carriers. Most plans give users free roaming these days, but carriers must still pay for the roaming minutes. The reasonong goes that it costs the carrier more to pay for the roaming than the customer is worth, so the carrier will drop the customer. Some phones, however, can be forced to roam easier than others, depending on the model. Sprint users seem to have the easiest time making this happen, but there is not a large enough sample available to know for sure.
  • The Consumerist has a story about Sprint dropping customers for calling customer service too much. Apparently, most of the calls were to correct billing errors, not to complain.

i just signed up with at&t service a few days ago.
im actually of thinking of porting my numbers to another carrier - now does anyone know if i will i be charged the $175 (or whatever it is) cancellation fee, since im doing it withing in the 30 days.

An ETF charge from my NEW provider to keep service?!??!

Here's the problem I face: I had Verizon (out of contract). I signed up for an AT&T plan and didn't immediately port and cancel my Verizon number. I wanted to compare to two services for a couple months before cancelling the Verizon account, and then porting the old number (which I've had for 10 years) to my new AT&T phone. Now I'm told that in order to port my old Verizon number to AT&T, I'll have to cancel the AT&T account, pay an AT&T ETF, and then resubscribe to AT&T which resets my 2 year contract, even though I'm not changing phones? WTF? I'm not trying to get out of a contract I've only been in for 4 months, I just don't want to pay an ETF just to transfer a phone number to a service plan I plan to keep with the same phone no less. Has anyone ported a phone number to an existing line before, or is it only for new service? Is there no sane solution to this ?!?!

Followup to my prior post: It turns out that the information I received from the first customer service rep was rubbish. I called back, spoke to someone else who was very helpful and said "No problem". The number port was done in 10 minutes with no charges or contract changes. Easy.

Say no to Contracts

Prepaid is the way to go - no contracts! I once had to pay $175 for early termination so I learned my lesson - never again! As a X-mas present to myself, I bought a StraightTalk W385 and for $45/month I get unlimited talking and texting and if I decide I no longer like the deal, I am free to get out anytime. But I think I'll be staying with this one for a while :)

TMobile lied or misinformed me into signing a contract

My wife and I had T-mobile pay-as-you-go plans and since we didn't use our cell phones often and didn't 'text' we'd each spend $100 per year for 1000 minutes.

Last summer we decided to get our daughter her first phone and we went to the Tmobile store in our mall. We were told by the salesperson that you couldn't text on prepaid plans, and since I'd already promised my daughter the phone for her birthday, I believed I had no choice to sign up for the contract with 2-year commitment.

Recently we discovered that we could text on our prepaid plans. I felt completely taken advantage of. We are 7 months into a two year commitment where we're paying ~$55 per month. That's over $1200 for the contracted time.

Don't get me wrong, it's not that we can't afford it, it's that we were misled into paying THOUSANDS of dollars more than we needed to. I was very clear on what I wanted but was told it was not possible.

I don't believe the contract should be valid, because it was signed under false pretenses. Do I have a legally valid point?

You probably should have been

You probably should have been diligent and checked out all of your options first. The contract you entered into was not under false pretenses, otherwise it would be invalid. Information about other cell phone plans or services does not have any effect on the contract you signed (unless for some reason you had a contract wherein that was one of the terms, which isn't the case).

Bottom line: You agreed to pay T-mobile for the service that you wanted. You signed a contract to that end, and you are still held responsible for that.

There are many different cell phone companies, and many different plans. You shouldn't have just walked into one store on one occasion and assume you wouldn't be ripped off. If you want to avoid getting ripped off in the future, then you should try comparison shopping. Walking into the first place you see that has something you want will not usually get you the best deal. I thought this was common sense, but I guess that it isn't so common anymore.

Also, BTW, thousands (which you spelled in all capital letters, like a seven year-old might) is the plural form of thousand. In your case, you are referring to dollars, which would mean at least $2,000. Here's how that works: $1,000 = thousand; to make that plural, we add another one to it: $2,000 = thousands (or, as cretins may prefer, THOUSANDS). Your total over two years, at (let's be generous) $60 a month, would be $1,440. This is less than $2,000. Here's how that works: $1,440 < $2,000. Therefore, your idiocy in purchasing a cell phone has resulted in a cost to you of hundreds of dollars, not thousands. At least if you are going to put words in all capital letters (like a chimpanzee might do, if he were given a keyboard), you might want to check your math first and make sure that you are actually typing the correct word.

Good luck in the future, and I hope that my words of wisdom make it all the way past the gunk and grime built up after years of neglect into your critical thinking area where you can hold onto it long enough to not get ripped off again by not even thinking to check with another seller of a competing item to see if he can offer you a better price.

You REALLY want out of your contract? ARE YOU SURE? Okay, here is simply what you do. (Dont know why all you people here in the forum have to get so angry at each other.)

If you want out of your contract first go to your carrier's website and look at their coverage map. Find an area on the map where they do not offer any coverage in the area and surrounding areas.

Next, call your carrier's Customer Service number and tell them that you LOVE their service, however, due to a job transfer you have to move to (blah blah, and make sure you have a PHYSICAL ADDRESS of your "new house" you're moving to. Google maps is good for this.)

The carrier has no choice other than to let you out of your contract with no fees because they do not offer service where you live. Simple as that. It's already worked for me with Verizon and Sprint.

That sounds nice but i would like to add that with T Mobile, you have to have proof of the change of address, usually a utility bill in the account owners name, so you cant just say you live with your parents or something like that. You have to prove you moved there.

I am a Verizon Dealer and you do have to have proof. They will certainly let you out if you honestly do not have service. I have gone to a home where there was not service (mobile home) and outside it was 4bars. The metal made the phone not work. Because I was there I was able to get them out of their contract. i obviously hated doing that because I work there, but if it will not work for the consumer, you make the consumer happy. So if you happen to not have service in your home, you may be able to find a rep willing to go to your home.

This did not work for my brother on Verizon

He moved to Singapore from US. He called before moving, and Verizon said that he may or may not see an ETF. If he does, he'll have to call back and resolve. Ofcourse, the ETF shows up, and when he called, Verizon asked him to send in TWO proofs of new address (utility bills, driver's license etc). He sent these in mail AND faxed it to the fax# provided by the rep. The ETF never got waived and he got tired of trying (it was a smaller ETF, Verizon was already doing $5 off/month into the contract).

Early Termination Fees suck! Once I had to fork out $175 and it will never happen again. Now, I'm with StraightTalk and only pay $45/month for unlimited talking/texting - an awesome deal. And if for some reason I decide there's a better deal out there, there's no early termination fee as there's no contract!!!

1) A contract is just that. Sneaking around it by porting to another carrier doesn't relinquish you from the contract.

2) Turning a phone off is not a way to avoid a bill. You still have the option to make calls, you have chosen not to.

3) Boost is for homies - So is Sprint.
ATT is for Tech heads who want iphones and a restrictive, non transferable contract.

4) Ive had T-Mobile of nearly 7 years. Im 8 months out of contract but still with them: The term is called "floating". When youre with a company but no longer obligated by contract, you're FLOATING.

5) I know a way to cancel a contract, COMPLETELY, with no termination fee. But since I learned it, I will keep it to myself and use it for friends - I have and it's worked. I won't defend it, that would just mean I'd have to explain it. Piss off.

6) Prepaid is an option for a lot of you losers. Other option is "flex pay" via T-Mobile or a training wheels program called "smart access" where you can earn back your credit while earning respect from T-Mobile. After completing one year on "smart access" during which time you have never paid your bill late, you earn the ranks of regular post pay users.

T-Mobile offers 10c minute prepaid and a damn good reception coverage. Net10 is another company that offers 10c minute but their phones are cheap. Plus, T-mobile phones can be used as PREPAID or POST PAID (regular account) - it's based on the SIM card, not the phone! I've forgotten more about cellphones than most of you will ever know. I don't bitch at the Customer Service people...That's the main secret.

I worked at a T Mobile call center for over a year and it is horrible. i quit becuase i hate treating customers like shit and screwing them out of their money. I know almost all the tricks of the trade and even now as just a customer i find myself trying to get thru loopholes to get out of my contract.

You can be screwed with any service. Contract, flex, or prepaid. And im sorry, the black people are enjoyable to talk to. Its the indian people i am always transferred to. They dont even understand a word i say.

I guess it depends on the type of representative you are. I work for a T-Mobile call center and as a consumer I find them very reasonable to work with. They are ranking #1 for a reason in JD Powers as far as customer service goes. I am not an easy customer to deal with so I am used to the Type A personality customers who call in trying to get out of a contract. I can guarantee you that if you are with T-Mobile and you live and have a utility bill to prove it, in an area with 1 or 2 bars of coverage they will let you out of your contract. This is because they honestly believe that staying in touch with friends and family IS important and you should be able to do so from your home.
As far as the ethnicity of the person calling in or the person you're dealing with there are generalities or stereotypes that often prove to be true. This does NOT mean you're racist. I take 80 calls a day and I will tell you that Jamaican women yell more than any other ethnicity. I cringe everytime I get a call from Jamaica, NY. I don't dislike the people more, I just dislike their problem solving skills. These same people are often amazing once we've fixed the problem. They are more appreciate than caucasians. Just an observation. Good luck everyone in getting out of your cell phone contract. I am trying now to do it for my cousin on AT&T. :)

I just talked to a friend of mine who got out of his contract by calling customer service and refusing to grant permission to the changes of terms and conditions within the 10 day period or whatever as posted in another comment here. Try that. And DO be polite to the customer service people, they're not the one's who made the policies. They do know however of any loopholes that might exist and probably are a little unhappy with the company for making them enforce unfair policy and would definitely be more likely to help you if you were friendly.

My husband and I had a NIGHTMARE encounter at a Verizon Kiosk at the Glendale Galleria in January 2010. They pretended like they were an actual Verizon retailer, "gave" my husband a busted phone that Verizon NO LONGER SELLS, in exchange for a renewed contract. We contacted Verizon and they were equally unhelpful, obtuse, and absolute HELL to work with. They did explain, however, that the KIOSK was a third party and they WRONGED MY HUSBAND. I viciously chewed out the clown representative they sent us to at the Verizon store in BURBANK (and his fat manager tool), where there were a NUMBER of disgruntled customers for MANY reasons. The tool who took my complaint tried to sell us a crap phone for $175 and I dressed him down loudly. He told me to quiet down. I admonished him, louder than before, so that other customers in the store would hear the situation. A lady and her daughter came up to me and gave me their NIGHTMARE story of dealing with a busted phone they had replaced by Verizon multiple times and were trying to get the same thing again, but they were getting absolutely NOWHERE with this bought robots. She applauded my efforts. SO, MR. KIOSK CROOK IN A PITIFUL SUIT, BE GLAD YOU DON'T GET SPIT ON WHEN WE CROSS YOUR KIOSK AT THE MALL. CROOK, CROOK, CROOK, CROOK, CROOK. actually kiosks do have a LOT of "back ground fees" that is how they make their $... NOT ALL kiosks but the majority. i am a research agent for att and spend a lot of time finding these kiosks to have them shut down. it is illegal for them to add costs to their contracts but they do it... more often than not..

Wanting to bail on sprint after 11 years with them. They lied to me just too many times and the phone itself is crappy. Should I let ATT port my number or just get a new number? ATT said it was easy to get out of a contract, but worry they are telling me that so they can just sell another Iphone.

Porting(transfering your number) automatically cancels the line it was tied to, so if your take your number to AT&T and you are under contract with sprint, it will cancel your sprint line and you will be charged an ETF. If you call sprint first and cancel your number will be lost.

Sprint sucks

My boyfriend signed for a Sprint contract today. He had one before that gave him better minutes. The phone broke, he took it in and came back with a new contract and phone. Is there a grace period. He lives in Virginia. He hates cell phones but was driving out of town tomorrow for the day and needed a working phone. Which explained his rush. But noticed he is paying more for a worse plan.

I lost my job and ask to be let out of my contract with them. My husband is self employed and we are having a really tough time trying to make ends meet. I explained all of this to them and they still want us to pay $400.00 early termination. I can't believe this crap. I can barely afford to keep my home and pay the utilities. If I don't pay my bill they'll just shut the phone off anyway. So I think thats what I am going to let them do. Can they charge you every month if the phone is shut off?

It would appear that the regulatory charge that Sprint is choosing to pass onto you is connected to the change in T&Cs. This is important because the law states that if a company makes a material change to the contract, then the consumer has the ability to exit the contract without an early termination fee (ETF) if they notify Sprint within 30 days of the notice.

This is true, I just cancelled my Sprint account with NO early termnation fees. They raised the Regulatory Charge from .20 cents to .40 cents/per line effective 1/1/10 and it should show on your January bill. You have to call customer accounts and tell them you don't agree with the increase and would like to cancel your contract. Be sure to tell them you were advised there would be NO early termination fee. Good Luck!!

how to protect yourself

since he is probably still under a grace period to try the phone he can go back in and threaten to leave and port his phone # over 2 another company like Boost Mobile which has no contract limits and offers a $50 month 2 month unlimited minutes, texting, internet plan. Also this article mentions that they are not supposed 2 change your original plan. If he doesn't want to leave or cannot leave Sprint he can look online on craigslist or in the ads for used phones. Sometimes other shops that specialize in wireless service will also have used phones.

It wasn't that hard to get out of my contract.

I've had AT&T since 2006. Service had been livable until the Iphone came out and then I couldn't make a call to save my life. You could literally look at my bill for a solid 3 months and see only incoming (missed) calls; no outgoing (something I later brought up with the service rep while canceling).

I called AT&T and they suggested several fixes, none of which worked and most of which sounded like a load of BS. After a week of daily calls, I decided to just switch to Verizon. I didn't tell AT&T anything, I just ordered my Verizon plan and phone, ported my number and waited for it to arrive in the mail.

When it did, I had EXCELLENT Verizon service. For the first time since the Iphone craze, I could make calls. When I called AT&T to dispute the ETF ($175), they were adamant that I'd have to pay the fee. I carefully explained that (1)my contract was up in 3 months (2) that they had failed to deliver on their end of the contract and (3) they were lucky I wasn't asking for the $120/month for 3 months I paid for and received extremely sub-par service. After a few mins of explaining all the steps I went through to correct the problem before cancelling, the rep finally agreed to adjust the fee. Even then I had to make her say what she was adjusting it to. I wanted her to say I wouldn't have to pay anything.

I felt bad for getting a little mean with the woman, but AT&T had made a decision (Iphones) that had a consequence of leaving me and many others without service. There's no way I was going to stay in the useless service and I was certainly not going to pay them for canceling my contract early when it was their fault I had to cancel.

AT&T early termination

My husband and I are in the process of switching from AT&T to a local cell company (Cellular South). I was prepared for the early termination fee (we are about a year into our current contract and will pay $115 for one phone and $125 for the other), but what I wasn't prepared for was the fact that we will still be billed for service for the remainder of our current billing period even after we have cancelled our service and moved our phone numbers over to cell south. In other words, my current plan at AT&T is $115. My next bill cycle is 12/1 to 1/1/2010 and I am billed in advance. If my service is cancelled today, I would expect to be credited back for the days that I haven't used, but instead, I am told that there is no proration and I will be billed for the entire month regardless of when I cancel. In addition, I will be billed by Cellular South for the same month. Has anybody else come across this kind of situation?

My daughter moved to Kansas for college and has no coverage. I have 5 phones on my plan. I tried to get out of the contract for 2 of the 5 phones because of no coverage. The only way out of the contract for the two phones is to show a utility bill in my name from kansas. What the Fuc its a damn college. they wouldn't take the colleges word for proof of residency. It only takes $710.00 to cancel all 5 phones. They would rather lose $2400.00 a year from a customer, then end 2 contracts. Thanks AT&T i'll go To Sprint or Verizon.

T-Mobile SUCKS - DOWNGRADE PLAN UNTIL CONTRACT RUNS OUT - HOW TO

Wanted to get out of contract. Didn't want to pay $200. Since I only have 4 months to go, I did the math.

$39.99 plan with 9.99 ulimited text plus taxes = $58 a month. So: $58 x 4mo's = 232

$200 cancel is cheaper.

Downgrade plan to cheapest option and remove unlimited text = to go down to $29.99 they would do this if I paid a "downgrade fee" of $35. WTF? so that is: $29.99 (cheaper plan minus texting) with the $35 "downgrade fee" plus taxes and normal fess which is now: $29.99 + $8 taxes for last 4 months = $151.96

BUT! I didn't like that either and so they sent me to "Customer Loyalty Dept." who said they could hit rock bottom at $19.99 a month, plus tax and would waive the "downgrade fee" of $35. So now that is: $19.99 + $6 tax X 4 months = $103.96

Now that my texts are shut off at TMobile and my plan was down to $19.99 a month, i just turned off the phone and will cancel on my end of contract date.

So, I got Straight Talk at Wal Mart (hands down cheapest way to get plenty of talk, text, picture text, and 30 Internet). Simple to do and save TONS of cash!! Over $300 saved per year even with the $100 phone I bought. Although they have some for $39, $79, and $99.

I SPENT A WHOLE DAY COMPARING EVERY SINGLE NETWORK AND PLAN AND PREPAID VS CONTRACT AND NO CONTRACT, ETC.

That is what I was told by a Sprint representative by chat but I still find it risky to cancel. Especially since the copy of the conversation sent to my e-mail was missing all the numbers like dates and amounts of money. There was asterisks instead where we typed numbers.

Sprint is ridiculous! Their customer service sucks and I am on a mission to get out of my contract without paying. I have actually already switched my number over and will be getting my new phone today but I refuse to pay them another cent! I have had so many problems and I kept calling and they were like "uh uhh well... umm" Yeah no help at all! Then when my phone completely just shut down I was given two options: Go to a store to see if they are able to fix it or wait till the 1st so I can get a $150 discount and extend my contract for 2 more years in order to get a new phone. Neither was going to work for me. I'm going to start emailing sprint and calling and chatting and hopefully after bothering their lives they will let me out without charge!

Call your provider and tell them that you are moving abroad. Make sure you say that you are moving to a country where they do not offer serivce (dont tell verizon you are moving to Puerto Rico or Canada). Tell them you found a new job and won't be back.

Tell them that you are moving to portugal, spain, france, England, argentina, or something like that. Europe or South america work the best.

T-Mobile: Don't say anywhere in Europe. Say a country in South America.
Verizon: Don't say Canada, Mexico, Puerto Rico, or any country that offers Vodafone. Say you are moving to South America (best bet)
Sprint: Anywhere except maybe canada
AT&T: Any country other than canada.
Virgin Mobile: Don't say anywhere in Europe or Asia.
US Cellular - Anywhere other than Canada.

Just because they use GSM doesn't mean diddly-shit. Vodafone uses GSM, but they still don't have service in the Phillipines. You need a vodafone tower in order to recieve vodafone service.. same for any network regardless of GSM or CDMA.

Actually No Cell phones in Okinawa work unless you have an Okinawan cell phone company *ie softbank or docomo. FYI. Verizon and AT&T will tell you they work in Japan but trust me i lived in Okinawa Japan and the phones dont work.

I moved to Guam on military orders and was told that Sprint has roaming coverage and it will cost more but, they do have service there. After contacting some of my friends already on Guam I was told that there are no "Big" company brands of service there. Long story short I had to bring in a copy of my orders to be faxed over to the main office so that I could get out of my contract by proving that I was being stationed overseas.

Actually you really can use moving as a reason to get out, just because they have the best global service they will charge you a ridiculous amount sometimes to retain an American number. One of the benefits of being in the military is if deploying or being stationed overseas you can cancel any contracts no charge as long as you supply a copy of orders.

I know when i worked at t mobile you could cancel if we (t mobile) changed something in the contract that the customer doesnt agree to, like raising text charges, overages, all that good stuff.

but you cant just simply say, "i see the 411 rate has been increased, ive never used 411 but im going to use that to get out of my contract." thats not gonna work. you have to show that it has inconvenienced you.

if you have a rate plan you often have overages on but are ok with paying the small fee, you might get a huge bill with the same amount of minutes because your plans overages were increased. (going from 20 cents a minute to 45 cents a minute is a huge difference) and not wanting to sign another contract for a better plan is understandable when they're the ones that increased the rates.

At t mobile you have to have an example like this happen to your account at least 2 months in a row for them to let you out of your contract. you might have to fight a little because a rep is going to try for the life of them to convince you to stay. just ask for a supervisor.

not eveyone knows this and it sounded like a good place so i hope it helps someone that might have this problem. (or if you want to cancel and theres just been a change in the contract, you might be able to use it to ur advantage)

It seems criminal to me that the companies are even allowed to change rates without negating the contract. Legislation needs to happen to fix this. If I sign a contract that says $0.20 for every overage minute, then that is what I should pay for the remainder of my contract. A change in fees should equal a termination in contract automatically. Consumers have no power here, someone needs to step in and fix things.

The other issue I have with all of this contract crap is that if I buy a smartphone they make me sign a two-year contract. Fine. If my phone dies in 13 months I am SOL and need to buy a new phone out of my pocket. The problem is that the conditional rebate on the smartphone in the first place stipulated a 2 year contract. So if I chose to buy a $10 ebay phone to get me through the end of the contract, I would still have to pay data...

Companies are given way too many protections. Something needs to be fixed.

they're expensive and not even a big time company. i want to switch to sprint so bad, but i've only been in my u.s. cellular contract for six months. i haven't had dropped calls or anything, so i have nothing to complain about, i'm just bored with their service and i want a new phone (from sprint). should i waste my time arguing with them, cancel my contract, or just shut up and finish out the contract?

I have had some different services, and been around many people with other services. Many times they use my phone to get out. I have had U.S, cellular for a while now. They dont have as many bells and whistles, but the service is better than any as far as getting out. Very Satisfied with U.S, Cellular, but I don't like the 2 year contracts to get a phone, but I guess that goes with any of them.

The way to get out of a Sprint contract....

1. If you have a Nextel phone, call and get your number ported to Boost Mobile. But first, go and purchase a Boost starter kit from the Sprint store for $21.00. Call Boost to get the service transferred and activated on your phone. It can be any Nextel phone, new or old, as long as it holds a SIM card. If you have a Sprint phone, call them and get a Nextel so you will be on Nextel service. Or go to Best Buy and get the cheapest Nextel/Boost phone that has a SIM card and when you finish transferring all your lines, take it back. You have 30 days to do that. I have done both ways and they work perfectly!!!

2. You get $10.00 worth of credits from Boost on the starter kit. So just use that up and don't buy anymore minutes. Then you are finished! I have done this 4 times and most recent was in June because I wanted an iPhone. I was on a family plan with Sprint. I just had to do it with both lines. You can use the same starter kit and same phone for each line, just one at a time. Just tell them you want to transfer the other number to the Nextel phone. They will cancel the other Boost number (which was your Sprint number) to activate the other line.

3. No matter what Sprint tell you about the early termination fee, don't beleive them. They told me I would have to pay $400 for my lines in June because I transferred both lines over to Boost. I said ok, because I had already done this before and knew it wasn't true. Sprint owed me $157 because you pay for your service a month in advance. Do this as soon as your billing cycle begins to get more money back. If not, you have still gotten out of your contract legally becasue Boost is Sprint on the prepaid side. They must do it if you want to. Me and my son had Instinct phones and now we both have iPhones and love it! 

4. Let me know what happens or if you need help completing this. I will find out if the other carriers do this as well since they all have a pre paid side, I don't see why not.

Tell me if I got this right.

I have a Nextel I580 through sprint with an unlimited minutes and direct connect plan. I have about a year on my contract left with the cancellation fee being $200. So, all I need to do is go buy a Nextel boost stater kit, activate it transfering my number over to the new boost phone. Then, after everyting has been switched, the boost phone is still a sprint phone so there is no cancellation fee. Now, being on a prepaid boost phone plan, I can use up the prepaid minutes, transfer my number to another carrier, such as Verizon or whatever, and there are no cancellation fees so I now have a new contract with a new carrier and didn't have to pay any cancellation fees. Does this sound right???

When you call them and they send you a new phone, it is them SERVICING your warranty on your phone, so complain about the manufacturer, not the carrier. I work at a kiosk inside of costco and that crap drives us nuts; "i dont like how they do this and that" which most of the time they are only SERVICING. Hey everyone i just canceled my t-mobile service contract with no ETF, I got a letter in the mail stating there overage minute rate was going up to 45 cents. In order to cancel with no ETF your contract must have been activated (or renewed) service prior to June 28, 2008 and you must have had an overage with your minutes in the past 6 months. The person I spoke with was nasty but I had all my info on hand like the month I went over and what the contract stated. It took me no more then 10 mins to cancel with no ETF.

A collection account, no matter how much it's for, is still negative credit and will hurt your credit score. It stays on your report for 7-10 years and will do most of the damage within the first 3 years. I've seen peoples credit tank b/c of a $50 medical payment or a $75 phone bill... but who am I, right? I just look at credit reports all day.

contract cancilation idea

I knew about the early cancilation fee for Verizon. I had two weeks or something to see if it worked. I tried to get reception at my home and couldn't. I bought $1000 worth of antenae equipment that the dealer sold me. Still no reception. They took back the equipment, but by then it was too late to cancil the phone contract.
I changed to ATT and got perfect reception. Now I want out of the Verizon 2 year contract without the termination fee. Verizon calls every day and demands their money.
Here's what I'm going to do: (I have the time) -- I'm going to sit outside the verizon dealer with a sign that reads "Verizon service stinks! Go down the street and get better service from ATT. -- I'll bet it works. I do this kind of off the wall stuff all the time.

Verizon, as every other carrier must sell services they advertise. Your not legally bound to the carrier if they were unable to provide service for ANY amount of time! 14 days OR 1 month. Do NOT let them fool you. Tell them the FAIR COMPETITION ACT allowed you to switch carriers with no penalties because it's ILLEGAL to prevent a competitor from taking business. Tell Verizon they are breaking the law and you will report them to the FCC and FTC!

Call your carrier and threaten them that you report them to BBO and any local state consumer protection agency, and the FTC for fraudulent and deceptive practices.

I did that to get out a bad internet cable service; and was able to get out without paying a dime. I simply called up the Customer Service and spoke to a manager.

I did the same with HP for selling a defective laptop that died within weeks of warranty expiration. Initially HP refused to fix the laptop; so I put it in $200 to fix it. Then I reported HP to BBO; within 3 weeks I was reimbursed by HP.

Congress is considering laws to correct the mandatory 2-yrs lock-in and other anti-consumer practices of the cell-phone carriers.

They don't want to get complaints through BBO and other consumer protection agencies.

Sprint Issues

Sprint sent my boyfriend a second phone, on a family plan, to try out. He decided he didn't want it, so he sent it back in the required time, in their packaging. For the last 1.5 years, he's been charged $60 a month for that phone even though he has called and told them it was returned. Now, 1.5 years later, they are saying they never received the phone. They will not help him. He has been calling and all he is hearing is "you signed a contract". Does anyone have any helpful ideas? In addition to this, he asked for the $99.99 everything plan. They gave him the $69.99 everything digital plan. He's ringing up overages like crazy. It is his fault that he wasn't checking the bills and didn't discover this immediately, but come on, a little help would still be appreciated. He now owes $427 for his monthly bill and overages. If he cancels, he will get charged $400 ($200 per line) for the phone he uses and the one he never used. That phone was never even activated. NEVER EVEN ACTIVATED and they don't see a problem?

Well, I can't help with the fact that Sprint are being unscrupulous bastards, but what I can do is help with the overage charges. They probably won't volunteer this information, but you can purchase additional minutes in blocks. 100 additional minutes cost $5. I recommend checking the minute total on the line every 4 days or so. You can do this by dialing *2 from your Sprint phone. Follow the prompts to check minutes usage. If you are getting close to going over, call customer service and purchase a block of minutes. It has saved us hundreds....we learned the hard way! Hope this helps you!

If and when you cancel your contract phone, you can then purchase a prepaid cell phone and start saving money! With a prepaid cell phone, you pay only for the minutes you use and can use the phone to text as well. Since I switched to prepaid, I have save over $30 a month on my cell phone bill. I would recommend this to anyone who is in the need to save money.

It seems that all pre-paid plans' minutes expire. Although the expiration period increases as the pre-paid amount increases, these plans still effectively have a per-month charge. If minutes are not added at least every month, the unused minutes, as well as "roll-forward" minutes are lost.

Not a problem if you're the "average user" (790 minutes per month), but if you're just looking for an occasional-use phone for emergencies, the lowest cost plan for less than 200 minutes per month is still $13/month (Tracfone), and limits you to that one carrier's network.

The complexity and terminology of these plans makes default credit swaps look like a picnic. One might conclude that the only real benefit of these plans is for people who can't get credit.

I don't use my cell a lot, so that 1,000 minutes lasts me 3 or 4 months, which breaks down to $25-$33 per month.

Why go through the whole bother - switch to prepaid! You'll probably either have to wait till your contract's over or bite the bullet and pay the penalty, but at the end of the day you'll still come out ahead. With prepaid you only pay for what you use/need. No hidden charges and no cancellation fees. After years of contracts I switched to NET10. I bought the prepaid phone at Wal-Mart and it came with 300 minutes included. Each call is .10 and texting is .5. Best decision I've made. I'm saving more than $50 a month! Aren't these savings worth the switch? I think we've had enough of cancellation chains.

Can I hold Provider to the Price I signed contract

I signed a contract with Att&t after they bouht out my provider. I was told that the bill would only increase $5 and the plan woudl remain the same... I signed a 2 yr contract to switch from old provider to new (ATT).

I have had problems ever since. Constant need for adjustments, eventually my 'agent' was banned from my account - and I have been told by ATT that they will not be adjusting any more bills, and the bill is now over $20 more than I signed on for.

I DO NOT want out of the plan (they offered that for free) But I WANT to force them to honor the price that was agreed upon when i agreed to sign the contract!!

I've had this nextel phone for a while now and my upgrade is August 1st. Ive have nothing but problems with this phone. My test messaging, internet, 2 way and calls will randomly stop working... ive tried to talk to sprint about letting me do my upgrade early so i can get another phone for free! but they keep saying no only $50-$75 off another phone and im like no... im a new mom and i dont work and the husband only brings in enough to pay my car insurance, internet, the cell phone bills, and rent. we only have enough for diapers and food is there a way to get a free phone without paying any money for it??

You can go to walmart to upgrade your phone...If you are only eligible for the 1/2 upgrade ($75.00), Walmart will honor the full upgrade and you can pick any of the free upgrade phones that they have in the store...I have 3 phones and have been doing this every year. How I got out of my cell phone contract

After fighting with AT&T for a very long time, I looked around on the internet and found a company that took over my cell phone contract the same day. I did pay about $40.00 but it was far less then the termination fee AT&T wanted. After doing this, I saw they also had plans I could use without a contract so I signed up my 17-year-old for that service. It has come in very handy when I took away her cell phone for a month and did not have to pay for service since I wasn't in a contract. Canceling an unlimited family plan with t-mobile

I have been a loyal customer with t-mobile now for five years and have been trying to get out of this contract for about a year now. Speaking of which this is a three line plan that is completely unlimited. There are not really any changes to my account other than the usage charges as well as the listing; other charges which is completely different every month and i have paper copies to prove it. Does this apply to the "materially adverse" clause or is there anything else i can do to get out? I have been noticing a decrease in my coverage and i can't even use my phone inside my own home now, I have been there for six years so i highly doubt it has anything to do with the home. I live in Chicago and had been with T Mobile for about 6 years. I noticed a severe decrease in coverage that started around Jan. 1, 2009. My girlfriend, her mom and I had to call many times to complain. One of us would call about every 3-4 days to complain and finally after about 3 months, I asked them if I can break my contract without a fee and they said ok. They had my numerous calls on file and I explained that I didn't want anymore more minutes free. I told them, even if they gave me 1 million minutes, they are useless if I can not get service. I am still with them for the mean time, I have two lines and I am trying to find a plan somewhere else that is not too much more money then what I am paying now. I hope this helps, good luck.

Trying to cancel T-Mobile without paying ETF

I have five lines, three of them are up for renewal, but I want out of the contracts for the other two. The issue is spotty service in areas their maps show as good. I have good service (usually) at my home but 1/3 of a mile away I have no service, can't even send or receive text. (Friends with other carriers have perfect coverage) Of course I want to switch all the lines to a different carrier. I called T-Mobile today to discuss the issue, once again. They offered me a cancellation fee of $100 a line to cancel now, as opposed to $200, that was after I asked to speak to the supervisor - I once again explained the issue and told them very politely that I have to go with a carrier that has service in the areas I spend my time. I have calls dropped even along I-5 in WA state. I told her that I need to talk to her supervisor and was told he was in a meeting (yea, right) but he would call me within the next 24 hours. In the mean time I have filed a complaint with the FCC, http://esupport.fcc.gov/complaints.htm we'll see how far that goes or if I'm able to cancel after I tell inform them I've contacted the FCC.

Sprint sucks

hey whats up guy's a couple of years ago i had sprint which were i lived it sucked big time and it was constantly dropping calls every 5 minutes so i went to att and i spoke to a rep there and we were talking about my contract with sprint and he told me if i wanted to join att all i would have to do is bring in my phone bill from sprint and he would surender my contract with sprint and renew it to att he said by law if you decide to choose a different carrier you can and your current carrier would have no choice but surrender your contract with them. you will still be charged a ETF but at least you dont have to stay with a carrier you do not like. also you can even keep your same number cause by law they have to surrender that too so dont let a contract fool you into thinking your traped cause your not. also he was telling how good he thought t-mobile was too so i know he wasnt trying to rip me off hope this helps

this is not a law. it sounds like all the ATT rep did was make you pay the ETF with Sprint, and then reduced your 24mo. contract a few mos. to reflect what remained with Sprint. More than likely if it was more than 6 mos. left and thats all the rep cared about to make their commission.

need some advice

Hey everyone, i have a dillemma that sucks and im broke right after pay day because of it. I lost my instinc not too long ago and i had it deactivated so whoever found it couldnt make it any calls. i went to sprint store to get another phone and since i didnt ave insurance on instinct i had to pay retail on a new phone; so i bought high note.. the representative at store had told me i should be able to recieve any voicemails, texts and everything that instinct got as well as my contacts which were backed up online after 4 hrs. I went home and after 6 hrs i didnt recieve anything; so i called customer service and after about 1 hr we finallly found out that the backup system on instinct is only for the instinct, not for any other phone... so they said to go and get instinct and download contacts to computer and then return it and get another phone if i want. so i went to sprint store and got instinct and paid a huge difference in price and i went down street and plugged in laptop and waited and finally got contacts off website to computer and i went back to store to see if i could return my phone and get my money back and also cancel my contract but they said i had already done exchange from highnote to instinct and that i could cancel contract and pay 200 but the phone was mine to keep they werent taking back..... i hadnt planned on getting an instinct.... anyone got any advice... wanna get out of that gay company.

I wondering if I will still get hit with an ETF if I exeed my spending limit and they cancel me for not paying. will I still get the ETF OR will they just cut me off and i will i have to pay only my balance??????????????

If you just dump out and don't pay, the account will eventually cancel and you will be charged an early termination fee. So, besides your balance owing, you will have $200 plus taxes... But, it would take a bit before you would get canceled for going over your spending limit/ and then for non payment. Have you checked into a payment arrangement or making sure all the charges are valid? I work in customer service there ...let me know if I can give you any more help...

sprint told me wrong

I purchased a instinct in Sept. cust. rep told me false info to get me to purchase insurance. Now my phones touch screen is not working and I tryed to exchange phone at the store like the rep told me to do. Now they want me to take my phone to a repare place in a differnt town than where i live and let them see if they can fix it. I told them the rep said i could exchange it in the store. They said cust service reps make mistakes all the time, and not to worry about it. They wont exchange my phone. I been with sprint for over 6 yrs. and I told them I didn't like have someone lie to me. i asked to leave them and break my contract, they said no. Its now been 2 days and my phone is still broken and not sure what I should do. My account is current and i have insurance.

The first link ( What is the self-service Phone Replacement Program? )is a very brief overview of the Self Service Exchange Program, and you can click the link in that page to get to the actual Self Service Exchange site.

It's the self-service option to get your phone exchanged. Instincts are known to freeze on the screen. Basically, this link processes a replacement and exchange order. If you have TEP, and there isn't any liquid or physical damage (damage beyond repair, like broken in half) to the phone, you can exchange it that way... but your account MUST be current. If your account is delinquent from late payment, the phone will not ship out. You can also dial directly to Tech Support by dialing *2. They can do some troubleshooting, and once they decide it's time to replace your phone, they may tell you to take it to a repair center. Tell them that you went to a repair center, and they were out of stock. At that point, the agent is supposed to ship you out a new phone. TEP and account being current rules still apply.

Call Sprint until you get what you want

The thing with Sprint is that you have to continually call and complain until they give you what you want. Don't take no for an answer. If they wont do it, ask for a manager! Once you ask for a manager, they know you're serious and they will do whatever you want. It's a hassle, but it must be done. I've had the same problems. If you call, they'll mail you a new phone. The people in the stores are stupid, they don't know anything. You'll probably be sent to the repair place where they'll make you wait for an hour only to tell you to call the insurance company to have them mail you a new one.

You'd be surprised.... we actually are more likely to help you out when you're nice to us, instead of being a dick, screaming for a manager, and being all huffy. And screaming at a manager is grounds for having your account canceled and charged full ETFs for all your lines.
