Cingular early termination fee refund notice and claim forms in the mail

UCAN News

Current and former California Cingular customers start receiving refund notices in the upcoming days. The refund is a result of the poor customer service case UCAN brought against Cingular and the CPUC's decision that Cingular imposed improper early termination fees from 2000-2002. If you are eligible for a refund directly from Cingular, you will automatically receive a check. If you are owed a refund due to an early termination fee from a third party agent, you will receive a notice in the mail.

The following is from the California Public Utilities Commission:

YOU MAY BE ENTITLED TO A SIGNIFICANT REFUND FROM CINGULAR WIRELESS.

The California Public Utilities Commission has ruled that from January 1, 2000 through April 30, 2002, Cingular Wireless improperly imposed an Early Termination Fee ("ETF") without a grace period for early service cancellation on many customers who signed up for wireless service. The agency has ordered Cingular to refund all ETFs paid to Cingular or a Cingular retailer (such as those operating in mall kiosks) between January 1, 2000 and April 30, 2002, and to refund ETFs collected on or after May 1, 2002, for contract cancellations during the first 15 days of the contract.

IF CINGULAR HAS ALREADY DETERMINED THAT YOU QUALIFY FOR A REFUND, YOU WILL AUTOMATICALLY RECEIVE A REFUND CHECK.

This check will be sent to you automatically. You do not need to submit a claim form, although you can use this form to update your address.

I had a similar experience

I had a similar experience with NY resident. Now I have a bill in collections in the amount of over $1000.

Check has not yet been cashed.

Because i've been moving from different locations since, I have not been able to open all my mail. I have only been opening current utility/cable bills. I finally got a chance to open all the "extra" mail. But just realizing that I can no longer cash the check I have received.

Any advise?

What about states other than CA?

I had cingular and was charged ETF for 2 lines. I however, live in NY. I never got anything in the mail. What recourse do I have now?
The Cingular charges are on my credit report and have been sent to numberous collection agancies.

Any advice is much appreciated.
