Telemarketing Law Violations

By Law, a telemarketer can be sued in Small Claims Court for any of the following violations of the Telephone Consumer Protection Act (TCPA).

national do not call and calling times

I was put on the national do not call list almost 3 months ago for both my cell phones as well as my home phone. Tonight I got a call from western national marketing. They refused to give me any information about the company. They also called at 9:40, which is 40 min. past the allowed time for calls. I know because I used to telemarket. How do I go after them? I know I could take them to small claims court....that is if they were a real company at all. Anyone have any ideas? No I do not have caller id on the home phone that they called.

Scammers like to do "Surveys" to bypass do not call restrictions

The subject says it all. Scammers will call stating they're doing something for your existing account or want info on what your opinion is. Then you're eased into the deal of a lifetime, etc.

SPAM MESSAGES TO CELLPHONES

Also done is TEXT messages. By using the reply option to call back and text "STOP" will usually end the practice, from that one source.

AUTOMATED CALLS TO CELLPHONE BY UNITEDSTATESRXCARD.COM

BEWARE!! The company, unitedstatesrxcard.com is calling your cellphone number and leaving a pre-recorded message on your voicemail if you do not answer.

This message is VERY LONG and uses up the phone minutes! They refer you to the website.
