ok, tell that to the damn telemarketers that hang up on you for saying you want to be on the no call list. It happened to me a few times. So telemarketers deserve every bit of being cussed out.If you want to take action against a company that continues to call you, make sure you have evidence to back up your claim. For example, send a certified letter, return receipt requested, demanding to be placed on the "do not call" list. Keep a copy of the letter and the return receipt as proof. Also, keep a log of all calls.

I was out in the Garage Painting some parts and the phone rang, I turned to walk to answer the phone and tripped over the leg of my sawhorse. I sprained my ankle pretty bad. The Number on the Caller ID was MIK Co with a 978 area code.
If they are a telemarketer I am going to sue for loss of work and my doctor bills.

Has anyone found out address information for MIK CO? I've been receiving the same calls & since it's an automated message I can't speak to anyone or send a letter requesting to be put on a DO NOT CALL list. Help!

One thing that you CAN do is file a complaint on the National Do Not Call Registry website. Normally you have to have your phone number registered with them for 31 days before filing a complaint, but the website states that in the case of automated, pre-recorded messages you do NOT have to wait. Make sure the next time you get the call, to note the time and the phone # - you'll need it to fill out the form. I just got a call from this company today and immediately went to the website. Telemarketing calls - especially for debt reduction or consolidation - seem to be on the increase lately, and I actually had one of these companies tell me it wasn't a sales call, they're offering a service. Sorry - if we have to pay for it, then you ARE selling something. The only calls that are exempt from the National registry are businesses that you have an established relationship with (your bank, a retailer where you made a purchase, etc.), recorded and personal political messages, and charities. But you can request that those entities place your number on THEIR do not call lists and they have to comply.

Another thing that I have done is report these companies to the Better Business Bureau in the city the call comes from - this also can be done on-line. (Use an on-line area code look-up or reverse phone look-up website to find the city where the company is based.) The Better Business Bureau DOES investigate these complaints, and will respond back to you with follow-up information. I've found this to be very effective when getting multiple, unsolicited calls from a particular company.

This Mik Co keeps calling me for almost 8 months now. They do not have live person on line though and a recorded message that sounds like live person. They made me feel sick today. They wont stop. They call at all odd hours. I only have a phone number for them & not an address. I'm so tired of unwanted callers. Some have called at night time when I'm asleep. They have no right to ever call my personal home number for any reason when I did not give them the permission.

I will only get 1-2 telemarketing calls a day. (Never leave a message, and call all times of day and all weekdays.) It has nothing to do with lenders, creditors, etc., except those losers who have most likely sold my info. SO, I work at home, and can sit here in relative silence until I MAKE or RECEIVE a call - whereupon I immediately receive a telemarketing call after I hang up on my own call. I am talking seconds later. Of course I don't pick up...screw them. But I cannot find a description online of any such telemarketing software. Does anyone know of software or system that perhaps "pings" groups of phone numbers for a busy line, so they know who is "home" and just waiting to be pestered? This happens ALL the time, and is more than a little weird. Also sounds like a great boon to telemarketers, and one that should be outlawed if it ever existed.

Like most any industry, a few bad apples spoil it for everyone else. Yes, I know, telemarketers are just trying to make a living. But if I politely tell them I'm not interested and to take me off their call list (even though I am on the do not call registry), I expect it to be done. Why would I want to sue one of them? Maybe because they are calling me 6 times a day, are rude, and refuse to stop. If the telemarketing industry would police itself, there would be a lot less people who hate it.

We lost our father on 9/11 leaving my mom no choice but to work .. and you people are saying to blow out the ear drum of the next person who calls. Why don't you try hiring people for better jobs. Well, Today is the 07/23/2009 and I'v recieved 27 calls from the same telemarketing not including the 8 missed calls.
I've called the people back 10 times today to let them know I wasn't interested. Everyone I have talked to said they were going to add me to the don't call list. That hasn't happen. It is now 8:55pm and they are still calling. They have been calling since 1:50 pm. Now I'm asking you, What more can I do? or better yet ask your mom?

Some Call Centers are imposing number of calls to their agents making the calls irresponsible. In our call center, we make calling informal, no quantities needed, customer are well targeted based on criteria and we make sure we are in utmost courtesy.

I pick up the phone wait for some one to ask for me/head of house hold then start screaming like I'm being attacked saying don't shoot then slam a book on my desk (like a gunshot) and scream again then hang up. I figure It will wast their time trying to figure out what to do or their time telling some one else asking what to do. Some times when I'm bored I play along for as long as I can before saying "can you hold on for a moment" then listen for how long it takes for them to hang up. I figure if your going to wast my time I might as well have some fun.

They usually will remove the number in a day or so.

Most people have experienced it--that annoying ring of the phone just as dinner goes on the table. When you answer, you find it's not a call from a friend or family member, or even from work. It's someone calling to sell you something--a telemarketer.

If you are frustrated by the number of telemarketing calls you receive, or annoyed by the barrage of hang-ups and "dead air" calls by automatic dialers, you're not alone.

The good news is that new laws have thwarted invasive telemarketing practices. A national Do-Not-Call registry offers a simple and effective way to block unwanted solicitations.

There are many other laws on the books to discourage irresponsible telemarketers.

For example, did you know that the FCC prohibits sending unsolicited fax advertisements unless the recipient grants the sender permission to fax the advertisement?

Did you know that telemarketers can only make calls to residences between 8 a.m. and 9 p.m. unless they have your prior express consent or you have an established business relationship with them?

Did you know that a telemarketer cannot place a call to a residence using a prerecorded commercial message unless the called party consents or the call is for emergency purposes?

Major federal laws that regulate telemarketing include the Telephone Consumer Protection Act of 1991 (TCPA) and the Telemarketing and Consumer Fraud Abuse Prevention Act.

Filing a Lawsuit Against Telemarketers

Consumers now have the right to sue a company in state courts in order to stop solicitation calls and/or receive monetary damages. By statute, you can receive up to $500 in damages per violation or, if the court finds that the company willfully or knowingly violated the new do-not-call regulations, up to $1500 in damages per violation. You could also receive actual monetary losses; the court has complete discretion in setting damage amounts for such cases.

If you want to take action against a company that continues to call you, make sure you have evidence to back up your claim. For example, send a certified letter, return receipt requested, demanding to be placed on the "do not call" list. Keep a copy of the letter and the return receipt as proof. Also, keep a log of all calls.

If you are ready to sue a telemarketer, determine whether you can sue in small claims court. This can save time and money.

Telemarketers have a new scam now. They tell you they are taking a "survey". What it ends up being is a sales pitch. Goddam those puke losers.

I wonder who your research is for

It's interesting that you claim telemarketing can be a good thing, but can't provide any data as such. (Along with not providing proper grammar.) Some of us are concerned because we continue to be harassed at home by telephone marketers even after registering with the do not call list. When we moved to a new home the calls started, 10 and 15 times a day. At least 6 different numbers just trying to sell us a subscription to a paper. If you really know how "good" telemarketing is, I encourage you to educate everyone, with details and not simply your opinion.
