Smart/Advanced Metering Unconstitutional
I urge UCAN to re-evaluate its support for the Smart/Advanced Meters which detect, record and report usage of individual appliances, when they are use, at what time of day, when the occupants of the home are away, etc.
This material can be used in court.
A defendant may be surprised to learn that he may be denied his constitutional protections of the 4th and 5th Amendments (undue search and seizure, due process and protection from self-incrimination) because he has tacitly waived these rights when he 'permitted' the installation of these meters on his property.
There's another constitutional problem the utilities face: eminent domain. I have informed my utility company that they may not trespass on my property to install their new meter. They responded that the CPUC has granted them permission to access their meters at all times.
That's funny - I didn't know the CPUC owns MY property and can give someone permission to trespass on MY property.
I'm looking for an attorney who is familiar with constitutional issues and would be willing to represent us in a class-action lawsuit.
