Can I back out of a trade?
Hi,
I ordered a new Ford 2 weeks ago. Dealer agreed to $4500 on my trade (which I still have pending delivery of my new vehicle). I now have a private seller willing to give me $6500. Can I back out of the trade portion of my agreement. It should be noted that I have employee pricing so there was NO dealing on the price of the new vehicle to play into the net cost to the dealer.

What is the recourse after signing note and then realized errors
3 days ago my son (21 yrs old) and two family members went to a Champion Toyota dealership in Texas and purchased a 2010 Tundra with no extras (just a work truck). I stopped by the afternoon negotiated the invoice price with the salesman and left a $5000 check for downpayment. I had to run to a class so I left all three to close the deal. I get there after the class at closing time to find out that my son was left all by himself to close with the finance manager. There was a signed agreement before the documents were drawn up; however, a few things happened (a) the note does not state the invoice price as previously negotiated and agreed upon instead it states msrp (2) there was a signed agreement for a total of $3000 discount, but the note states only $2000. In addition, they sold him extras that is not necessary (i.e. theft protection, tire & wheel/roadside assistance, GAP insurance). He already did not have credit and had to establish, so he got a high interest rate and a higher monthly payment. Do I have any recourse? I need to get the extras off the note and the discount and price originally negotiated ((that one page signed prior to the documents printed). Do I have a case?
I bought a "lemon" and want to know if I have any legal rights?
I bought a car from a used car dealership and everything seemed to be just fine. Before I actually drove the car home, they assured me that they had done a thorough check of the entire car. Everything seemed fine, at first, but then within the first week, when I slowed down the car, it would just shut off sometimes. I was usually at an intersection and would have to restart the car quickly; sometimes afraid someone was going to plow into me from behind. I had the car for a total of three weeks and i broke down, overheating off the side of the road. I had the car towed to my house and was trying to figure out where I would get it fixed. I told the dealership, seeing how it was early on and I was in their office making a car payment. The car was cheap, but I paid all but $600.00, which we had spread out over three months. They towed the car from my house and I would then struggle to get a hold of anyone about the status of my car. I would call and was always told that I would be called back, but never was. After two weeks, I was told that my car would be ready on a Monday, which turned into everyday that week, until the following Monday. I even stopped in b/c no one ever called me about it. So they were fixing my car for three weeks; just as long as I owned the car, in my possession. The timing belt had blown and the original reason that I even trusted them to do the work is b/c they seemed so willing to help and guaranteed a $25.00/hr labor fee. So, $738.00 later (which hasn't been paid, yet), it was said to be fixed. I drove the car for two days, before realizing it was leaking some weird colored substance. I was not going to bring it back to them, so I had a friend who is good with cars, take a look at it. As soon as he opened the hood, he pointed out and showed me a piece that was completely sticking out of the car and was not where it should've been. After taking it home and elevating it, for further inspection, he found that the problem was they had patched my car up with grease. My friend said it was either done on purpose or someone who fixed my car had absolutely no idea what they were doing w/ it; after dealing with these people, I lean toward the former. My friend then did the work that needed to be done. He said the CV Boot was completely shred (we kept the old part for evidence), he even took pictures to show what was wrong. He had to also replace the Ball Joint. Out of pocket, I paid $200.00 for parts, to my friend. He didn't charge me labor, which was a 6 hour job. After I complained to the car dealership, they said I should have brought it to them, but it would have cost me so much more. Not to mention, probably would have taken forever and not be properly done, anyway. After threatening legal action, they were willing to say that they would reimburse me for the $200.00 in parts, but that is not good enough to me. I just happened to take it to a friend, it would have cost much more. Not to mention, I was driving a very hazardous vehicle, that could have just broken down in the middle of the highway, for all I know. So, three months have passed and I paid off my vehicle and I should have received my title to the car; however, they are holding it as collateral right now until the $738.00 is paid off. I paid off the car, I want my title. They are afraid I'm not going to pay, but they did the work, I just want it to definitely be negotiated. Added, to top it all off, it still leaks excessively. I have to check the oil, each time before I get into the car and add, as needed. Additional costs just keep adding up. I really need some advice, as to what my options are with this situation. Dealerships should not be allowed to get away with sending out faulty, hazardous cars and have no repercussions or accountability, at least. Please Help!
late contract changes
I purchased a used 2007 Scion from a dealership in Baltimore, Md. I signed the contract for the vehicle approximately 17 days ago. Today, I got a phone call from the finance manager stating that I had not been approved for my original loan contract. He said they could only approve me for a contract with a shorter span of time (66 months instead of the agreed 72) therefore, increasing my monthly payments to way more then I can afford. Can they legally make me pay this increased amount or make me return my car? I do not wish to return my vehicle. I just want to pay the amount I signed for on my contract. What should I do?
getting down payment refunded
I would like to know if after putting money down on a used vehicle,if the car dealer than tells you that the financing didn't go through,can my money be refunded?I've had the car since 4-6-09, but had only had possesion of it for one week before things started to go wrong with it.So what I want to know is can I get my down payment back?
Lease Contract - Toyota Camry
Greetings.
Firstly thank you for your services.
The background is I signed a lease contract for an internet based price with inbuilt cash back of $1500.00 After doing the credit check The dealer asked me how much down payment will I make. I said $1500.00
With no $1500.00 from my side they mention $3000.00 less 1st month payment.
Again, as normal I was made to sign the papers, with the normal music sign here,sign there... which I did. BUT with the understanding that I will go through in details since it is my first time that I am leasing a car.
Doing a research and understanding in details , it turns out that the deal is costly than the competition available.
It was a saturday and immediately next day-sunday I call to the sales person to hold on the deal UNTIL I get a better deal.He says his finance guy will call me which he did.
I get a call and they make me go through the same amounts, which at the end I told to cancel the transaction.
Now the team is using pressure tactics like "I can be in trouble, The contract has been sent to the manufacturer, The details have been sent to DMV all this without taking a single dime from me.
Am I legally bound to pick up the vehicle.
Please help.

I recently purchased a car 2006 Suzuki Grand vitara. It had 36,000miles on it. Now it has 39,000 miles. The bearings on the back are bad, the car pulls to the right, and it has a cry in the steering when the wheel is turned. The service dept. wants me to pay for this, but I only had it a month. They didn't tell me that I needed an extended warranty. I have a warranty, but it's for the drive train. what must I do?
Used car contract
On Monday April 7 I stopped to look at a Jeep on the lot at Automaxx on Rt 7 between Marietta and Reno, OH. I test drove the jeep, which was leaking oil and decided not to purchase it. I asked the finance manager how much they would give me for my car, and he said 10-11,000 dollars. He said he would have to talk to his manager and see exactly how much.
On Tuesday April 8, I stopped to see how much they would give me for my car, but both Rodneys were gone so no one could tell me.
On Wednesday, April 9, I stopped to see how much they would give me for my car and was told 10,000. I saw the Toyota sitting there and asked about it, he said it was 5995, I said thats too much so Rodney came down to 4995. I felt nervous about driving the truck in traffic since it had been about 15 years since I drove a standard, so the heavier Rodney drove me just down to the gas station in Reno and back, and while we were going the gear raked when he was trying to put it in 4th gear. He said he guessed he wasnt good at driving a standard either.
Back at the car lot, we discussed the frame being cracked and how they had fixed that, he said they put new shocks on it and fixed everything, he said he had 700-1000 in fixing the toyota.He said they had put a heavy undercoating under the truck. He said it had not been detailed yet and I said I would clean it up myself, and he said he would knock 150 off if I did the detailing myself, that brought the price down to 4750.
I said I would like to sleep on this and would he hold the deal open for me until the next day. He said well, I dont know, there are others wanting this truck, so if you want it you'd better take it. So I said how long do I have to decide? He said only until 730 that night. They all kept talking to me about how my car would probably not sell fast and that they had several people in line for the truck, so after about 10 minutes of talking to me, I finally said ok. Then Rodney told me that in order to save on the taxes, he would put down on paper that I paid 2750 for the toyota and he paid me 8000 for my 2005 Mercury Montego Premier. The papers were drawn up that way.
While I was signing the papers, I told the finance manager that I thought I was making a mistake, and he said well, Ive already got the papers drawn up and I felt guilty so I signed them. I felt very pressured at that point.
When I left the lot at about 6:20 PM and started home, I got on 77 north and got up to speed, and right away noticed that the front wheel on the drivers side was shimmying a little, when I got home and got out of the truck, I smelled gas. I came into the house and looked at the clock and it was 7PM (under 45 minutes later, but not enough time before they closed to return the truck). I called immediately and told them I didnt want the truck, that it has a shimmy in the drivers side wheel, and I was having trouble with the standard transmission, but they said it was sour grapes and that they would not take the truck back. When I went to work the next morning, I noticed that it was getting harder to get the truck to go into 4th gear, it would rake and I had to shift directly from 3rd to 5th. The dash only has half its lights, and it has parking lights out on the passengers side. The cigarette lighter doesnt work, so you cannot charge your cell phone in the truck. I took off work an hour and went to the car lot and spoke to Rodney who said it is too late, I already signed the papers and they were already on their way to be processed. I asked them to stop the deal and they would not. I told him at that point all the other problems I was having with the truck.
And then I found the gas leak around the seam of the gas tank. I have used 70.00 worth of gas just driving 300 miles. And it is leaking oil.
The paperwork they gave me after I signed the papers says local trade on one paper and that it was bought at the auction on another. It also says the retail value of the Toyota according to BlueBook is only 3900 and thats assuming it is in excellent condition. So 2750 was closer to what this truck is worth, and 8000 is truly what they gave me for my car. Retail on my car is almost 18,000. They lied to me about the condition of the truck, and about how much they were giving me for my car. Now I am wondering what else is covered up by the undercoating.
I stopped Friday night April 11 for the check for 4780, the difference minus all the fees they charge, and went to the bank to cash it, and thats when I noticed the back of the check says by endorsing this check you release the title, and I decided not to cash it.
What I would like is for them to return my car to me and I will return the truck and the check to them. They have not sold the car yet, and I have not cashed the check.
Do I have any recourse other than them fixing the problems with the truck? I want out of this contract, and told them so within an hour of signing the papers.
Why?
Never buy a vehicle without getting all the information first and ALWAYS sleep on it. never buy it on the spot. The dealer played you. Thats what they do and how they make their money. Sorry.

My boyfriend blew a oil pump according to the garage that we towed his Dodge Ram 1500 1998 PU truck to. AAA endorsed the tow truck company (ALL points Towing) and the tow truck driver suggested this garage because the turn around time would be faster and was close to home. The company has been there they said for 15 years. When the truck was picked up (yesterday) my boyfriend has noticed a small oil leak. He is watching the leak but the real problem is, my boyfriend feels there are other discrepancies and that the motor was not changed as was quoted in the repair. $ 2700 for another engine with 78,000 miles, gaskets, and labor.
I suggested to go to a dealer, get something in writing if the engine has not been changed. My boyfriend has a 6000 miles or six months warranty on this repair. Can you offer any other ways to confirm this repair?

Stop Payment on Bad Vehicle Purchase
My husband and I purchased a vehicle from a private party in Minnesota. It was a 4WD truck. We took it for a test drive, and I was concerned that the 4WD might not be working. The seller indicated that it was working. We purchased the vehicle for $1200 with a check, but the seller did not have title to the vehicle and said he would turn the title over when he got it. We drove the vehicle home and started having problems with it. It overheated and we were having problems with what seemed to be related to the 4WD. We took it to a shop and they said the 4WD was not working on the vehicle. So, I stopped payment on the check and the next day, we proceeded to drive the vehicle back to the seller. The vehicle broke down on our way, and we had to have it towed. While it was being towed, I followed in another vehicle behind it and noticed that the vehicle seem to have a rather wobbly wheel. We stopped and looked at it. All but one lug nut had broken off and the tire was about to fall off completely! The seller had tried to cash the check and it was returned because of the stop payment. However, it appears that he then scratched off the check number in the upper-right and in the micr encoding, and cashed the check again, and this time, it cleared my account. The bank is currently investigating the stop payment issue. My questions are:
1) I realize that a sale like this is "as-is". However, since the title has not actually been signed over to me, what recourse would I have, and am I likely to be able to return the vehicle and get my money back (give court battles of course)?
2) If the check numbers were scratched off, is that illegal? How likely is it that the bank will honor my stop payment request (Wells Fargo account)?

what did you expect for a 1200 dollar 4wd? The most reliable vehicle around? You have nothing to complain about and should save your money next time until you can afford to own a 4wd vehicle.

I brought a vehicle 22 days ago. It fail inspection. I call the dealer asking them to repair the damages, they said they are not responsible for a vehicle wheather not it pass or fail inspection. I would know is this legal can they sale you a vehicle for 20,000.00 used and it don't have to pass inspection? Also can I return the vehicle back to the dealer? I think thats bad business.

My friend paid $4,000 on my current car loan then I traded it in for something that would not brake down she got upset with me and canceled the payment to my bank. The dealership took my van as a trade in and gave me $1,500 for it. I owed $5,596 on it. I got a call from the bank and Now I own $4,ooo on my van and I now have the new used van. Will the dealer take the new van and give me my old van?
