Contract Fraud
I got a phone in the mall from a Tmobile both. It was a flex plan month to month. The plan with no contract and I never signed one. I went back six months later to cancel on line on the phone they told me that the phone number was under contract. The store couldnt bring up or find any contract on there computer. It wasnt even under my SSN. They told me to go back to the mall were I brought the phone. The booth closed down. the official Tmobile store in the mall said the booth was crockett and fraudulent that why they got closed down. Niether that store was able to find a contract in the system an still not under my SSN. I called custormer service and they could find one either. But they said I was still under contract. The booth keeps the contracts when they close which I never signed one. And that there is nothing I can do. The supervisor thought it was funny and asked me if i want to change it to my SSN. They want $400 to cancel both lines. What should I do?

Switch to another carrier....See how bad you get screwed by Verizon if you so much as think about changing anything on your plan your contract gets extended. None of the carriers are perfect...i bet your cable company is a pain in the a$$ too ....if it wasnt one thing it would be another...take a handfull of cell phones verizon,sprint,att, trac phone or whatever and ride around and see what happens...one works the other doesnt then the one that wasnt working is now and the other one is not....get over it its a RADIO there are dead spots...Peace!
AT&T ROLLOVER MINUTES ARE A SCAM
I agree. The rollover minutes are a total scam. They give them to you to make you feel like you are not losing minutes if you buy too big of a plan, but then they strategically keep them from ever being used.
1) If you add a person to your plan, you might start using those minutes. So they cancel them.
2) If you downgrade your minutes per month, you might start using those rollover minutes, so they cancel them.
3) Then, if somehow, a lot of people on a particular plan seem to be using the minutes up. They cancel that plan and force you into a change. Then they cancel your minutes because you changed.
The only way you CAN use the rollover minutes is by greatly increasing your talking time without adding a phone line or changing any features.

only time you loose rollover mins is if you downgrade. its not the end of the world you only loose some not all and if you talk nice to the rep on the phone or store you can keep more...not a big deal... its when you cop an attitude and blame the sales rep though...just be cool and see how a lil kindness gets gets you what you want..they cant FORCE you to change anything they can only suggest...big difference. Adding someone to your plan doesnt cancel anything....Do your homework get some knowledge about what you are talking about before you post things like this ....PEACE
Rollover Minutes Scam
My problem is by no means a monetary one but AT&T's false advertising absolutely burns me. On the commercial for rollover minutes, the woman picks the mini clocks out of the trash and turns to her children and yells, "Rollover minutes NEVER expire." GUESS WHAT!!!! YES THEY DO!! I just called AT&T and reamed the guy out saying "never" from what I understand truly means "never." It doesn't in any way mean "if you have the same plan for 12 months, you will continue to lose said "never expiring" rollover minutes every month that you don't use them." So the rollover minutes I earned last October will expire this month. MY GOD, WHY SAY NEVER IF YOU DON'T MEAN IT.....I WOULD LOVE TO SUE THEM FOR FALSE ADVERTISEMENT.

I think this is a bit focused on one aspect of their wording versus experience - I'm pretty happy with the rollover minutes... and in my experience I always have this pool of minutes to pull from so in essence they are "always" there. And they do have a disclaimer on the screen... trust me I by no means even like AT&T for other reasons, but unless using 'Never means never' is akin to bringing down Capone for Tax Evasion, then I feel there are bigger issues with the provider. Just IMO.
I've recently been shopping
I've recently been shopping for a prepaid plan since we are now retired and use our phones rarely. We currently have a Verizon family plan, with two lines sharing 700 minutes. Last month we used four minutes. The bill is $63/mo so that's over $15 a minute. That's why I'm looking.
I was looking for the company that used these ads (shows how good ads are since I recall the mother and son but not the company). After finding out that it was AT&T and looking into their plan versus Verizon's plan, for prepaid, I may as well stay with Verizon.
I find it extremely misleading when they claim that their minutes don't expire. You may want to wave off 'Never' as an exercise in the mentally absurd but I do think that if you buy minutes that don't expire, and are rolled over, then they should last one heck of a lot longer than a month.
I am leery of AT&T since the last time I tried them, and found their service area weak, it took me over a month and dozens of hours, to cancel within the 30 day grace period.
Now that I know that the ads showing us that the minutes stay fresh from month to month is pure bunk that makes me loathe to try AT&T again. Twice burned is something I try to stay away from.
The US consumer of cell phones needs cheaper options. The Europeans keep showing consumers how to pay less but we refuse to listen.
AT & T combined billing Rip-off breached our contract
Please email me or tell me who to go to in Tennessee to get help. I have been reading hundreds of reports how AT & T has ripped off so many people and lied. We are being double billed and was sent to a collection agency in less then 30days now they are threatening to put it on my husbands credit report.

AT&T minutes fraud
I have a family plan with AT&T and have 3 lines in the family plan. Mine is the main number the second one is used by my husband (which he never uses) and the thrid by my brother. A few months ago we had over 1200 roll over minutes and 1500 minutes combined and I got a bill of around $300.00 (normally it it around $120.00). I looked at the AT&T call log online and saw a bunch of calls to my Husband and brother's phones and it looked like it was coming form their own number. However, there was no record of those calls on the phone's call log. I called and complained they said the only way the charges could go away was if I increased my minutes and paid the higher rate. And so I did that. The calls would nto stop though. I called many times and complaned also opened up a complaint with their IT services department but they just refuse to accept that it could be a mistake. I continue to get those calls and they show up on my at&t bill but I still dont see any record of them on the phone. Not only is this nfair and bizzare but is also turning out to be a very expensive problem. Any advice?
AT&T Erroneous "Contract Fee"
My wife and I first signed a 2-year contract in March 2006 when we were married. Her phone died Feb 2007 and we went to pay full price for a new phone. The rep at the AT&T store told us to sign a new 2-yr contract and we'd get a rebate. So we did. Rebate never came through and we were told it was because it was too early to sign a new contract. Therefore no rebate. Seems to reason that therefore no contract either.
December 2008 (9 months after our original contract ended) my phone broke so we went to Best Buy to get a new one. The store employee told us we weren't under contract. I also spoke with an AT&T rep directly who verified we weren't under contract so we had our numbers ported over to Sprint. The following month we got a $150 early contract termination fee despite being told 3 times that we weren't in a new contract.
I asked AT&T for consideration but was told no. After they reported me to collections they re-opened the case and again determined that no relief would be given. I also wrote their corporate office but have heard nothing.
Collections offered to settle with me for $10 less than the disputed bill, but I refuse to be hijacked. So they said they'd report it against my credit as a "refusal to pay."
How can AT&T have their cake and eat it too? I either WAS in a contact and therefore they owe me my rebate....or I was NOT in a contract and therefore this erroneous early contract termination fee should be waived.
AT&T Contract Fraud
Two persons on our AT&T contract, my 84 yr old mother and myself. She wants a cell phone for roadside emergencies. I don't get coverage in my area and rarely use the cell service. Last billing our total combine air time was 14 minutes.
I added a phone and took over my mother's acct. "Send the bill to me." AT&T signed us up for a NEW two-yr contract -- under my mom's name, sent to my address.
Six months into no local cell coverage, mom agreed to let me drop my service and just have her phone on the acct. AT&T set up a NEW 2 yr. contract -- under the same name (my mom) sent to her address. AT&T convinced us to keep the second phone. Basically the NEW contract was for a "change of billing address." AT&T claims dropping the second phone is a "termination of contract" -- fraudulent though the contract may be.
My freebie Samsung died, besides which I wasn't getting coverage. AT&T convinced us that Samsung freebies are cheapo, and I could get coverage with a Motorola Razr -- so I bought one. AT&T set up a NEW 2 yr contract under the same name, sent to my address. So, this is a NEW 2 yr. contract for replacing dead equipment and changing the billing address. Name on the acct. has always been the same. (What happens when people move? New service contract?)
No coverage with this new phone. AT&T somehow dropped the ball and failed to bill us for November. January we get a bill for 2 months, 2 mo. charge for "free introductory trial" options we canceled, and "Customer Service" can't decide who actually owns this acct.
In the interim, I've been repeatedly locked out of the AT&T web site when searching for my billing. AT&T claims my mother is signed up for the site. (She can't figure out how to get online.) AT&T sends a "text message" to my mom's phone with a "new password" -- despite the fact that I'm the user needing to get into the sight, have provided ALL the required ID info, both my mother and I have blocked "text" and "voice mail" to keep spam from using our minutes, and I can't get a signal at my residence for a "new password" even if AT&T were to send it to us.
"Customer Service" in my area informs me that they aren't sure who the acct. belongs to, and can't check my billing; "You'll need to phone AT&T." (I can't get a cell-phone signal at the AT&T Customer Service storefront. Besides which, is not this storefront part of AT&T, and why can't their computers locate my acct. ??? They can sure as hell take my payment for the acct.)
Simple "breach of contract" issue here . . . No cell phone coverage, and fraudulent re-writing of service agreements.
I called AT&T at least six times in as many days. "Cancel my service. I'm disputing your billing, and not paying AT&T a %$@#@ cent. until this matter is resolved. Breach of contract. Failure to provide service."
AT&T can't seem to cancel service either.
AT&T needs to face a Class Action suit, have their smarmy butt handed to them in a bag.
cingular fraud
We have a family account with Cingular Wireless with Mississippi area codes. My daughter sells real estate now in Arkansas and therefore had to break off of my contract to get an Arkansas number. She cancelled her old number and opened a new contract with ATT Wireless with her own social security number. They apparently reassigned her old cell phone number to someone else and put her social security number on it. She has been getting collection calls on the old number, but when she calls back and gives them her current information she is told that her account has a zero balance. Finally, she was actually here to talk to the collection person who called and got the story about she still had the old number, even though it was cancelled months ago. She is still using the same cell phone but with a new number (which she pays the bill as soon as it is received).
Can we not file suit against ATT/Cingular for fruad since they have used her social security number to open someone elses account?

I'm sorry to hear you got scammed by CIngular but you must realize that things such as this one happen everyday to other phone companies as well. My mobile provider charged me 30$ more for mobile internet. I called them and they apologized saying I should pay the entire sum and not pay for the next months. Well, now I'm holding another 30$ bill for mobile internet.

I have been experienced the same problems. Not even my contract was extended with 2 years without me knowing it, but when I wanted to quit after the standard period they say I will have to ask this with 6 months before these 2 years. If I don't do that I can stop the contract only if I pay $500. I think we should avoif these guys in the future.

2-year contract fraud
I purchased an additional cell phone last at full price so I could have two lines on my account, which was on a month-to. I was told I would only have to pay $20 extra for the additional line, and that since I was paying full price for the phone I wasn't starting a new contract. When I received my bill the next month, I was billed about $50-60 for two plans! I called cingular and had it fixed (or so I thought) so that I would only be billed for a family plan. The representative didn't mention anything about starting a 2-year contract. Today, almost 1 year later, I called to cancel my account and the representative said I have to pay a $175 termination fee. I was told that although I never signed a contract, there was a verbal agreement in the store (lie #1) and I also made an electronic agreement when I set up the phone by pressing buttons (lie #2). I am really upset. I filed a complaint with the Better Business Bureau but I don't know if it will do any good.

Cingular cancellation fees and other problems
My 80 year old mother entered into a Cingular wireless contract about 2 1/2 years ago. She has rheumatoid arthritis and a multiplicity of other maladies. She was unable to see or push the numbers on the phone and didn't have any reception at her home at 15 Cadiz, Rancho Mirage, CA. She complained bitterly to me about the phone. I called Cingular to cancel and they said it would cost about $150. My mother refused to pay (she's on a limited budget). After wrangling with Cingular, I started paying for mom and took the phone. It has never worked well (I live 10 miles north of Evanston, Wyoming) and I've tried to cancel the contract before. The phone stopped working and, well...I won't go on. It's just been horrible. On Friday we finally just canceled the contract. They said they're going to bill me over $500 for the three phones being canceled. They've moved the contract renewal date on me (because I called to complain the phone didn't work). It's just a mess. I was thinking of filing a complaint in our state District Court but everything I've read is pretty disappointing (vis a vis the ultimate success of such a complaint). The complaint would only be a nuisance to them. The most viable of my causes of action may be the obligation of good faith imposed by the UCC, false advertising (regarding their network and dropped calls) and the restraint of trade aspect of their punitive cancelation fees.
Do you have any advice?
