Cell Phone Kiosk Plaza Bonita Mall

Let us know if you've been a victim of any kiosk/store at Plaza Bonita Mall by filling out our telecom complaint form at www.ucan.org or calling UCAN at 619-696-6966 if you don't have Internet access.  We will need your contracts scanned and attached to the complaint, faxed to 619-696-7477 or copies mailed to UCAN at 3100 5th Avenue, Ste B San Diego, CA 92103.  In order to best assist you, following these directions will save time to prevent collection actions.  Including any email correspondence with the company and letters sent to you by the kiosk/store or company pertaining to early termination fees owed, are needed.  UCAN will take it from there. 

UCAN is receiving complaints about Plaza Bonita Mall kiosks stating they are authorized dealers for AT&T Mobility, Sprint PCS, T-mobile and possibly other service providers. 

The complainants had no idea they were dealing with another company and thought they were purchasing service and equipment from the actual service providers. It is only reasonable to expect the same terms and conditions when the signs show the service provider name(s).

One Sprint PCS complainant upgraded his service at Plaza Bonita Mall.  The next day he returned to cancel the entire transaction because 3 of the 5 phones didn't work at all. 

An AT&T Mobility complainant went to Plaza Bonita Mall and upgraded 3 phones with the offer of a 4th phone for free.  She was given only 3 of the 4 phones and the company changed her phone #s that were supposed to be ported for business purposes. She went to the store the next day to cancel the entire deal after getting the OK from the service provider, AT&T Mobility.  She ended up in collections in the amount of $1,000; clearly showing the authorized dealer contradicted the terms and conditions of the service provider.  There was NO mention of any penalty by the kiosk store and no reason for the woman to ask since she had permission from the company without the penalty known as an "early termination fee" (ETF). 

UCAN believes that "when the company allows customers to cancel without an ETF, there must be a protocol where kiosks honor the cancellation awarded by the service provider".  Based on our experience, the service providers are willing to work toward this goal. AT&T Mobility (previously Cingular) stated that its authorized dealers are agents of the company and then proceeded to close up approximately 1500 kiosks that were not treating customers fairly (source: regulatory VP for Cingular).  Verizon Wireless has offered to meet with UCAN to develop a protocol.
