The following is an excerpt from the ruling:
Testimony and Discovery on Utility of the Future
I find that the moving Parties have made a sufficient showing that there may well be significant evidence that to-date was excluded from the applicants'served testimony and filed application. I find that this exclusion may directly bear on the Commission's ability to adopt just and reasonable rates for test year 2008, as well as to fairly adjudicate the post test year ratemaking issues, including the incentive proposals, to be decided in this proceeding.
Therefore, I rule that SDG&E and SoCalGas must make a full and complete supplement to its showing as described herein. I further direct SDG&E and SoCalGas to construe this requirement broadly and comprehensively in all responses. SDG&E and SoCalGas shall prepare detailed testimony, or make other filings by counsel, to provide documentation that includes the following:
- 3.1.1. Indicate whether the information in the Utility of the Future material was available to any witnesses at the time each witness prepared his or her testimony, and list those witnesses,
- 3.1.2. Indicate whether the information (particularly historical costs and forecasts) provided to all consultants on the project during the course of preparing these materials is consistent with the information provided to the Moving Parties during discovery in this proceeding, and explain any differences,
- 3.1.3. Provide a detailed explanation of whether the cost saving opportunities described in the Utility of the Future materials are fully reflected in the forecasts presented in the initial testimony (including specific citations) and indicating where, if at all, specific Utility of the Future proposals appear in specific accounts and testimony (including citing to the Utility of the Future materials). Clearly indicate any revisions to testimony for the inclusion of Utility of the Future,
- 3.1.4. Provide a Privilege Log that lists all documents being withheld on the basis of a claim of privilege and identify the author, addressees, persons copied, subject matter, and date of document. This privilege log shall include all privileged documents for the consolidated proceeding and is not limited to the Utility of the Future related materials.
- 3.1.5. Provide a full and complete update to all previously served testimony fully reconciling the impacts of the Utility of the Future on the testimony previously served.
