INTRODUCTION
Q. What is the purpose of your testimony in this proceeding?
A. The purpose of this testimony is to offer the Commission some context by which to evaluate this proceeding. I will discuss the genesis and details of the 1998-2001 Pacific
Bell marketing case, (C. 98-04-004) in which I was a very active participant, as well as the resulting sanctions. I will also discuss C. 02-01-007, a complaint subsequently
brought by UCAN against Pacific Bell for similar customer abuses in its DSL service. I then offer some observations about the current telephony market, the nature of complaints recently received by UCAN about AT&T, and those complaints' relevance to the marketing guidelines established in Rule 12.
Q. Please discuss your background, as it relates to this matter.
A. The Utility Consumer Action Network (UCAN) was a lead complainant in C. 98-04-004 and C. 02-01-007. I am the founder of UCAN, and have been its Executive Director
since 198[5]. I was also the lead attorney for UCAN, as well as its expert witness, in the UCAN v. Pacific Bell case that resulted in D.01-09-058 and the marketing rules which are the subject of this proceeding. Effectively, I lived and breathed these matters through much of the period 1998-2002.
