LTD Financial Services, LP Debt Collectors Consumers Beware
Consumer beware. LTD Financial Services, LP is a debt collection company that appears to harass consumers whether they owe a debt or not. One of our UCAN senior members was a victim of this practice. LTD Financial has a D+ rating with the Houston BBB where as of 3/4/10, 171 complaints were processed over a 36-month period of time. 135 of the complaints were regarding "Billing or Collection Issues". Our Chinese senior said the company called her incessantly and used abusive tactics to collect a debt she didn't owe. The company called her neighbors and family members to try to humiliate her into paying the debt. The customer alleged a racial slur was directed at her too. The customer's experiences match a Federal Trade Commission initiated civil penalty settlement against the company in the amount of $1.375 million. Threats to consumers included garnishing consumer wages, seizing their property, and initiating lawsuits or criminal actions against them if they refused to pay. The owners and top managers were permanently prohibited from these practices.
Even though the FTC settlement clearly mapped out what tactics could be used so as not to violate the Fair Debt Collection Practices Act, UCAN assumes based on its member's experiences, that the company's profits throughout the country far outweigh the settlement fine and a D+ BBB rating. Furthermore, there's a question as to what good settlements do as opposed to putting the "bad actors" out of business and filing charges against owners, directors and top management when a company continues "business as usual".

I have been dealing with ltd financial now for a few months. Recently I called to make a payment, and when the "man" on the phone asked for my social security number, I asked if there were another way to access my account. He rudely replied that "a third grader could get my social number." I asked for someone else was put on hold for a very long time. I then called back and had the same thing happen. I am now sitting on hold waiting to pay my bill. These people are losers of the worst kind. They obviously cannot keep a job doing anything but harrassing people. What a sad life.
LTD Debt Collectors Harassing Phone Calls
A company called LTD keeps calling my phone and leaving messages for someone else. After one particularly rude message left on my answering machine demanding that this person "have the decency to return their call" I called them. The person that I spoke to, when I informed them that I was not the person that they were trying to contact and asked them to quit calling my phone, basically called me a liar! Is there anything that can be done about these people??!! I get between 10-15 calls a day from them (they use 3 different phone numbers to call with i.e. Unknown Caller, a Houston, Texas phone number, and a 1-800 number). Even after telling them my name and phone number and they confirmed that I was not the person that supposedly owes them money they are continuing to call!! I'm getting really fed up with this! I'm a disabled person on home-oxygen and their constant harrassment is causing me severe health problems!! What can I do about this? Any suggestions would be welcomed!

A relative came home from work one night to find a voice mail message for ME explicitly stating (in a very rude tone of voice) that the caller was a debt collector, working for a debt collection agency. I used to be a debt collector (medical only) and I know the laws. You can't do that on an answering machine/voice mail unless the debtor states that it is okay to do so. It violates privacy. Do I owe the money? Yes. Was that my address or phone number? NO. In fact, the credit card agency had been given the correct information several years ago. As it happens, the number I gave them then is no longer good. I don't have a phone number any more. I can't afford it. I'm on disability and have had so many severe financial set backs in the last couple of years that if debtors' prison still existed, I'd be in it. I try to pay my bills but, like others have said, I pay a little to each creditor. It's all I can afford. As smaller bills get paid off, I add that amount to another bill.
I sent LTD a certified mail, return receipt letter (which they should have received today at the latest) telling them NOT to contact me any further and that I would sent them small monthly payments. After reading other entries here, I think I will send the payments directly to the creditor. I don't trust LTD.

I totally agree that you need to pay your bills, however with the recent economy, some people are having a hard enough time paying their mortgages, heating bills, electric bills, health care, food, etc. I was laid off for 21 months and went from $1000.00 a week to $400.00 a week. I applied for many many many jobs and did not get any. I just went back to work and it is part time and I am still making only $400.00. Gas, oil, electric, etc. has all gone up and citting $600.00 a week out of your pay is a big issue. We will pay the bills we owe but these businesses need to understand that a small payment is all that can be made. When they say no it is not enough let them take me to court. I own nothing. If they want my insurance when I die, good luck there too. I have nothing. These collection agencies are rude, tell lies etc. and I am sick of them. There is so much scam out there and who wants to believe anything these days. Also after 2 years, companies cannot file small claims charges. I worked for a county agency and after 2 years of no payments, etc. they are no longer able to file the claim!!!

got a call from them and they verfied my address and the last 4 digits of my social, told them that I can't pay bill right now because I'm pregnant and not working and family members pay everything for me at the moment. I told them that I will pay the credit card service directly and the collector insisted on having my bankincg account information. I didn't give it to him and he finally hung up in my face. How much informcation do they have already? Do they have my child's security information and other household members?

I have received a letter asking me to pay these people and I am not going to do that cause I just don't trust these people and I don't trust this company that is called LTD Financial Services cause I just don't know who these people and this company are and I have never heard of them before and they kept calling me and harassing me asking me to pay the amount that I supposedly owe them and I kept telling them that I don't owe any money to nobody and as soon as I told them that, they just hung up on me. I would like to see these people get shutdown as soon as possible. The sooner, the better. This company who calls themselves LTD Financial Services is nothing but a scam trying to harass and call people up and say that they owe money to someone and which they don't and nobody has the kind of money to just throw away or to send these people any money. FYI, in the letter I just received yesterday on Monday, February 7, 2011, the letter states that I owe someone which is a company called Bank of America that I owe them in the amount of around $1,000 in which I don't have that kind of money to be giving them and I don't owe Bank of America any money in which that is total BS. They also want me to make 1 payment of about $540 by the 25th of this month and save about another $540. I have never been in debt and I have never owed anyone and especially Bank of America any money to them. I just hope that these people at LTD Financial Services will just leave me alone.

i have been recieving calls from ltd for about a week now and they are not looking for anyone in my family or anyone i know. they call from 7am -10 pm i come home from work and there are so many messages from them . i have told them they have the wrong number and still continue to call . how do i make this stop? can some one please help , im about to call an attorney and sue there ass's for harrassment .

Two strange voice mails from LTD Financial Services made me enroll to the TransUnion credit report company.
They left two voice messages to me (they know my first and last name + home phone number) asking me to call back regarding a debt collection. They asked me to call back with an ID number they provided.
Simply as I do not owe any money, I disregarded the calls and deleted voice mails. I did not call back.
And I thought of a possibility of ID theft, and I had to enroll to TransUnion to look up all 3 major credit bureaus (TransUnion, Exparian & Equfax) credit reports. The credit scores look good, and no collection accounts were reported and no debt I see except for the ones I know (like auto loan balance and a few temporary credit cards balances that does not exeed 100 bucks). I never delayed payments (utilities, auto-loan, gym monthly payment, credit cards payments, etc.), and my scores are at 900 level.
If I get the same phone call, should I call back? Or, just disregard like I did before?
If there's something I should pay, I think the source creditor or lender should contact me directly via mail or phone call. But I do not have any debt that I did not pay off. All the ex mortgage accounts had been closed with paying-off according to the credir reports, and I am living at an APT.
Please give me idea how to handle the LTD Financial calls.

I used to be a collector at LTD, and it is a legitimate business. Also in response to a earlier post i saw, I knew Pat Small, and she didnt HAVE to be the one to take the payment, thats just how they are there. They also already have people's social security numbers and address, in fact they look up your credit report and can find all the information about you possible. They will see everywhere you've lived, your phone numbers, and yes even your neighbors and your family members. I believe there is a certain amount of legitimacy though because they are collecting money that was borrowed and never paid back. Even if you've run on hard times that's the price you pay for borrowing the money in the first place, and I understand cause i have been there myself. They knowingly commit illegal calls and forced me to do the same while i was working there. Once i got moved to a certain manager's team i was told to go to a phone other than the primary one i used, because my phone was recorded, to call the people who owed debt. They told me to threaten with law suits and calling the police even though they knew these practices are illegal. When i complained to the director she just told me that she put me on her team for a reason and to do what she said. I could not work in an environment where i was forced to do illegal things and chose to resign from the company. While it is a legitimate company that is collecting people's debt, they are also doing illegal calls in order to collect them.

After reading through your comments, I've realized you're working with this LTD Company. Quit being a troll. There are legitimate business practices put into place, and this company is breaking the law. I agree, people need to pay their debts. But this LTD has a D+ rating with the BBB. Look it up. Question to ex-LTD debt collector
In case they keep leaving message like "... exclusinve for (my name) ... please hang up if you are not (my name) ... in two seconds we will leave a message ... (after two seconds) ... Please have (my name) call 866-998-2500 with ref# xxxxxxxxx regarding debt collection ...", should I call back even though I do not owe any amount of money to any one.
Due these calls, I had to spend $15 to enrolll to the credit bureau's service to get the 3 major credit bureaus' scores. Nothing I could find related debt nor un-settled transactions. And my credit scores look nice.
I am very uncomfortable with these repeating calls from LTD Financial, and I even think about changing the phone number. What should I do?

I owe Bank of America almost $30K for a business loan for a business I had to close. Now LTD is calling me. I agreed to pay $10K to clear off the debt. I was worried it was fake or that they would come back for the other $20K I owe.
TRYING TO PAY ...
Ive been trying to pay this debt they claim I have but the website that takes payments never works for the account. When I try and make a payment over the phone they claim the only person who can accept a payment for the aacount is "Pat Small" or her supervisor. Everytime I call, those people are NOT available. They work the same hours I work. Ive called and stated my work schedule and that I cant call between 7am and 5pm est but no one ever responds. Instead, Pat Small keeps calling relatives of my ex demanding payment. If she would call the right fucking number, or answe when I call then they would have recieved payment a long time ago.
LTD phone call re:2nd Mortgage "debt"
I just got a call from an LTD debt collector. She called my work phone number. When I answered, she proceeded to inform me who she was, the name of the company, that it was a debt collection company, and that the call was recorded. This is all fine, I was OK with it. But then she asked me to give her my social security number and home address, so she could confirm my identity. I was befuddled: did she really think this was appropriate and that I would agree to it?! Alarmed, I replied that it was very weird that someone would call me at work and ask me for this information. She back off, and said she already knew the information, then gave me the last four digits of my SS to prove it, and asked if they were correct. They were, and I agreed to that much. However, I sincerely doubt she had any other information, which she did not pursue anyway. She explained that she was calling about my second mortgage debt (which is from a house foreclosure I had over a year ago in Florida).
I never imagined having to foreclose on my property, and I did everything I could to prevent this. My lender had required me to buy insurance for my 2nd mortgage, and I naively expected it would cover this situation. Isn't that why we buy mortgage insurance? I know the insurance company paid the lender, but now it looks like the insurance company has "sold" their incurred costs to LTD. I am very worried about talking to these people, they sound really sleazy. Should I have an attorney talk to them?
Also, I have serious concerns about how a mortgage insurance company can legally pass off a cost-of-doing business to a debt collector: it's an insurance company, they are supposed to pay for "when-bad-things-happen" as a cost-of-doing-business, aren't they? If they were an Auto insurance company, and I wrecked my car, I suppose they could refuse to pay for repairs if they thought I was misrepresenting the "accident", or they could pay and then sue me for damages if they could prove I was misrepresenting (i.e., fraud). But I would not expect an auto insurance company to accept my claim as valid, pay for the repairs, and then get a collections agency to make me pay them back. I don't get it. Why is this OK for mortgage insurance? If it's legal, it shouldn't be....and I wonder if there is any discussion anywhere about changing this ridiculous business model, or loop hole, or whatever it is.

LTD leaving private information on answering machines
LTD Financial left a message that they would contact everyone around the physical address and have been leaving complete details, along with the last four digits of my social security on their answering machines. I am pretty sure this is a direct violation of the Federal Trade Commission but apparently the fine was not enough for them to change their illegal behavior. I did file a complaint with the FTC but I am sure it will only be added to the thousands of other complaints against LTD Financial. The latest message said I forfeited my privacy rights because I was a public company. Wow... Did not know that having a business line of credit secured by my personal social security would mean I forfeited my privacy rights. Does this mean that LTD can openly discuss my business and slander my name now? How do you deal with this company that does not abide by the consumer protection laws of the United States?

Notice to cell phone owners in texas, massachussets and michigan, we cannot call you without your permission (it is against state law) but we still do it all the time b/c we figure people do not know this. you know i did collections for a small time, 98% of the employees do the right thing and try to help. everyone looks at only the small % of those that don't. Don't talk about hurting someone because your not paying your bills.

This company makes unwanted daily calls to phone numbers that no longer belong to the creditor. They are doing it to me. They have even been called by the cell phone company and told not to call my number as it no longer belongs to who they are seeking. They don't listen or stop.
Hopefully this time there will be criminal charges as well to further bring them under control. Their rein of terror will soon subside as others take similar action. They have nearly caused an auto accident calling while I am in traffic. Cell phones should not be used to harass people after they know better. Lives could be lost. In fact, FCC should ban any collection agency calls to any cell phone and save lives with traffic accident prevention. I suggest any one who wants a debt collected to use another company, as these people are so dumb they just keep calling wrong numbers and never get any results that way. I would not want these people making me think they are getting results calling old outdated phone numbers. Further, if you get a call from these people you would be foolish to pay them anything as they are a junk collection agency and the debt is almost always written off. Just do like the person who had my number did. Change your phone. Pay them nothing.
Calling other peoples houses
LTD has been calling my preacher's house. My preachers wife sent me the message with their name. How did they get their number is beyond me. I haven't gone to that church in over 4-5 years. I just called LTD and gave them my lawyers number.

Ever heard of just not answering your phone in a bad spot. Did you know that the average person that has a collection account is around 7. Yes that means that 7 accounts, and odds are that every one has the same phone number. Most of these accounts can't even be seen by the same people in same collection agencies thoughout the country due to privacy laws. Give the guys a break at least they are trying to help recover $$$ that is owed to the bank that can help us all in the long run.

They called me and after researching this i called them back to tell them never to call me again. The guy started yelling at me to make my payments and stop talking and the calls will not stop, they will call me everyday until i pay. Is this sueable??

This company is a public predator and violates every known rule and law on the books. After getting a new cell phone from Verizon, I found out the last owner of the number owed someone for whom this unsavory company had old phone number information. For months they keep calling no matter how many times I tell them that the person is not me. They make no effort to stop. They use local numbers and also unknown number titles. Apparently the lawsuit that they got hit with was not large enough to stop them. I hope several sets of handcuffs will work better. Pay day is coming for these creeps.

They keep calling my mobile phone looking for somebody I never heard of. I've told them at least 50 times to stop calling, yet they continue. On top of that, they call from a local area code even though they're based in TX.
How to stop receiving calls from them on your cell phone
Most cell phones are able to be set up so that each entry in your address book has its own ring tone. Just set a ring tone for everyone in your address book and disable the ringer for all other calls. Some phones even allow you to set a default ring tone for the address book so you don't have to go through all the entries.
I did that and it really cuts down on the number of calls I get. When a call comes in, all I get is a short beeboop that tells me I missed a call. Then maybe another beeboop that tells me the person left a voicemail.

A female from LTD called my husband at work about a past due credit card. She proceeded to make threats that she could take our home - she had him believing a judgement had already been made against him & that his wages were going to be expunged (causing his substantial trouble w/his employer). She not only discussed all his outstanding debit with him (from credit reports) - she also went into detail & discussed my debt with him (clearly without my permission). She had already spoken to me (just 5 minutes prior at home) and subsequently called him at work outright lieing about the amount he owed; threatening illegal action; and making him believe a judgement had been made. Again, without my permission she discussed my debts as well (which had nothing to do with the debt she was attempting to collect). She subsequently called me back & accused me of lying to her & my husband & denied ever saying the things to him (that he recorded & she clearly said). He settled the debt, but only after unnecessary harassment & lies. Since then, I have settled an alleged debt of my own (we actually settled all our credit card debts - those alleged/and real) & they have yet to cash the final payment which clearly states "settlement in full" which makes me weary that they are still attempting some type of fraud. I refused to talk to anybody there after what they had done to my husband & have communicated thru writing only. However, from his experience - do not trust them - there are still bad apples breaking the law in their collection attempts.

My Mom has dementia & a chronic physical illness. Talking on the phone is extremely difficult. They keep calling her telling her she owes $20000 on a credit card. Problem is, she doesn't. She's never even OWNED a credit card. The person who owes the debt doesn't even have a first name close to my Mom's. We've received nothing in writing from them, yet they keep upsetting my Mom calling her & telling her to start sending hundreds of $ to their address. It's humiliating for her, she's never owed $ in her life, she's depression era. Even their house & cars were paid for. So, before people go blaming the people who OWE $ instead of CROOKED DEBT collectors, they ought to know what they're talking about. PS. I'm my moms POA, when the phone gets handed to me, someone without dementia, they hang up. I'm alot harder to bully!!!!!

So I had a crappy message on my home voicemail this morning. Saying to give these guys a call regarding a judgement against us. I was pissed, I don't owe money to no-one. So after several attempts and not wanting to leave a voice message i got a hold of someone. They wreren't looking for anyone in my family, they were just grabbing names out of the phone book and leaving messages. I let them know that this wasn't cool with me. These guys suck! They are not very professional. So my advise to anyone who reads this is, don't painic, they are the one's with the bad credit..wmmaw

Look, this is not rocket science. Under the FDCPA, you can simply send a letter (better to do it return receipt requested) simply saying never call you again at any time under any circumstances for any reason, and that you are giving them notice that you are tape recording all of your calls (must give notice that you're doing this, otherwise, its a crime). they will never call you again. if they do, its either a mistake or sue them.
I am a collection attorney, and deal with this stuff 1000s of times a month. Yes, they may elect to sue you as if you owe the money, they are entitled to eforce their legal remedies, but they will not be able to telephone you.

It is my understanding that by the time a 3rd party collector gets hold of your alleged debt. The originating company has already charged it off. So they get a tax right-off on this AND I believe they have their insurance policy to claim this 'bad debt' too. Then if that wasn't enough, they then 'sell' the debt to a collection agency!

That is BS! They might do it, but it is against the law. After a person dies, their unsecired debt dies with them. It does not have to be paid by their estate. If it was secured, they would already have reposessed anyway, so i assume you are talking about unsecured debt. Check the law, don't fall for that one.

I am well educated in 3rd party collections. I used to do it for a living. The issue with not taking the settlement when offered or
starting to make payments with a payment arrangement is, after enough time has passed the company who owns the debt (should it be the original creditor or a bank that bought it) can pull the account and will most likely take legal action. And since you legitimately owe the debt, they will sue you for what you owe plus it will cost you court fees, paying an attorney, etc. I hope this helped.

What a company like LTD Financial might do is take your $800, and still go after you for the rest of the money. When-ever you settle, you need bona-fide settlement documents. You can't even be certain that the company you originated the debt with has agreed to settle. Technically, the company who sent the account to LTD must approve any settlement first.
The best thing to do is tell them to sue you in small claims court. Once you are served, you can then work out an arrangement with the attorney, who will abide by the arrangement, or you can go to small claims court. If you go to court, demand they present you with the original paperwork of the debt. If they are unable to do this, ask the court to drop the suit, and ask for $1000 for your wasted time. If they have all the paperwork, ask the judge if you can meet with them in the hallway and settle. You should be able to settle for 25% to 50% of the debt, and the settlement will be a court order.

ok the reason that comment is incorrect is a on each call they let you know the call is being monitored or recorded and i highly doubt that they would risk being suied thousands for your remaining $800. secondly the settlement does not have to be approved by the client the collection company can close the acct out at any amount that their director or manager aprroves. and thirdly if you take them to small claims court on an amount that you legally owe you will waist money in court fees and you will not get a court appointed settlement. the court will look at the agreement that you signed to have whatever account that this debt stemmed from as a legal and binding contract that you entered into voulanteerily and you will then be responsible for 100% of unless the defendent agrees to settle on a different amount.

I would take the settlement. When a settlement offer is approved, offered, and accepted it is official. they will not and can not come after you for anything additional. before you can even make a payment on a settlement, you have to be sent the setllement letter before payment can be taken. right after the settlement amount is paid, a zero balance letter is sent out right after and your account is automatically removed from the collections que.
As a former LTD employee, and speaking on behalf of LTD's procedures, its not LTD but rather the rotten apples that have slipped through the cracks. LTD is very strict on making sure FDCPA policy is being followed and even go further beyond FDCPA policy to ensure it. (such as not needing a Do Not Call Request in writing). yes, they do call relatives and neighbors in a process called skip tracing, but its only when there is not a verified number ID'd to be the debtor. once a good# is found, they cannot call relatives or neighbors.

I wish to pay LTD a settlement offer, but the offered time is due to expire today. I do not want to settle by phone today since the reason I am in this situation is due to a series of miscommunications, at best, or misrepresentations, at worst from a creditor, which I can't prove for lack of record. Attempting to complete the payment information on LTD online site, the site presents the full "debt" amount as due (including late fees and interest incurred by virtue of creditor error). Further, it does not seem to show today's date on the site's pop up page where the check information and amount authorized would be recorded by me. When I did complete the form and pressed "enter", the pop up screen appeared with yet another "confirm payment" button. I called LTD and the operator refused to answer my question, posed as follows: "If payment is made online, will the screen display a DATED printable confirmation page upon submission of payment." She insisted upon receiving the information by phone or getting a reference number to send me to the person handling the account to take the information. (presumably for their "success" tally). I offered that I was asking a simple question that only required a "yes" or "no" and that she likely would know, or could find the answer for me by inquiring with a supervisor, since creditors presumably are given such information to know the services you provide them in efforts to collect a debt. The operator replied "I can't tell you that, have a nice day" and hung up.
As a former LTD employee, or anyone else who has actually made payment online, would you have that information that you could provide. Since the screen reflects the debt with fees, I want verification that the date the payment was made online falls within the settlement offer deadline. (Further, I am concerned that if I provide my bank information (actually, I did already hit submit once and then got another notice to confirm payment) , that they will use that information to authorize further payment for the late fees and interest, which I continue to maintain that I should not have incurred. ) Thanks for a quick reply :) !

I had a Citibank Exxon Mobile Credit Card. I was unable to pay the card for about 3 months. Once I got back on track I began paying again. Exxon sent my account to a collection agency thus LTD Financial. I was paying Exxon directly, when I received a call from LTD financial telling me to send them the payments directly. My response was I am paying what difference does it make. So I continue paying and actually sent the next payment to LTD, do you know they called me and asked when I was sending my next payment. I told the guy who called this is harrasment and I don't believe you are calling me about a bill I pay each and every month. Look at the payment dates its always around 17 or 18 of each month. I just sent them a letter requesting to never be called again. I most certainly dare them to every call me again, I will contact the Consumer Protection division of the Attorney General's office in Maryland and file a serious complaint. LTD is very stupid!!!
