New Federal Law Mandates 90-day Eviction Notice to Tenants Affected by Residential Foreclosures

A new federal law provides a minimum 90 days' eviction notice to most tenants affected by residential foreclosures. This is 30 days more than the current California law which provides 60 days' notice.

This allows month-to-month tenants about three months to find a new place or work out a rental agreement with the new owner.

Do I need to hand deliver the 90 day notice or can I mail it

To the best of your ability,

To the best of your ability, take on a worst-case viewpoint. Your renter may seem nice, but you can never be positive how and when things may become different. List out each potential circumstance that could cause the delivering of an eviction notice and write out the reasons in very clear terms in their rental lease agreement. The tenant agrees to all the terms when they sign the rental lease agreement.

Why would you want these

Why would you want these renters to still pay for a 90 day notice. Haven't they been through enough lately with triflen landlords who have just been taking their money.

My only question is how you insure tenants are ACTUALLY getting their 90 days.

This law will change again very soon, I believe.

90 day notice

If I buy a property at a trustees sale and there is a tenant there, do they have to pay rent for the 90 days, or do they just stay there for free? If they are required to pay, and they do not, can I serve them witha 3 day notice to pay or quit, and proceed with the eviction before the 90 days are up?
