Best Windows & Doors files for bankruptcy

UCAN received documentation that Best Windows & Doors filed for bankruptcy protection on December 19, 2008.  Contact UCAN immediately if you signed a contract around December 19th, or after the date, by filling out the Best Windows & Doors complaint form .  The other bad news is that those of you who counted on the promised voucher plan sponsored by NERF (National Energy Rebate Fund), will not be collecting your rebate after the 4 years.  NERF is no longer in business either.  

The bankruptcy hearing is scheduled for January 26, 2009.  So, there's not much time.  Please note that one consumer alleged to UCAN that she had been sold solar for her home as late as December 31, 2008.  The Bankruptcy Court would certainly want this information in order to determine assets available to pay creditors.  One senior citizen told UCAN she financed through GE Money Bank, Inc and paid her bill in full (approximately $7,000).  GE Money Bank, Inc. paid Best Windows' owner Michael Chavez.  The owner and his company failed to pay the contractor who had installed decking and railing.  The contractor is now threatening a mechanics lien against this senior's property unless she pays them the same total she already paid.  

In tough economic times, it's understandable that companies and consumers are hurting.  What's unconscionable is the fact that Best Windows and NERF didn't contact these customers and simply tell the truth.  Continuing to sell when you know you are going to pocket the money and will cause harm to others is ruthless -- if not deliberate fraud, it should be.

It is disappointing to note that in spite of the utmost efforts that you have spent still you will end up with nothing..Bankruptcy is never a pleasant thing to contemplate. If you think you might have to file for bankruptcy protection, there are two options. Chapter 7 is where you have little or no property and you have an unmanageable amount of debt, credit card or otherwise and no quick payday loan can help. Chapter 11 is for paying off a percentage of the debt, if you are facing foreclosure or repossession. Chapter 13 filing gives you 3 to 5 years to pay off a portion of your debts.
