Scam 1. Negative Equity/Trade-In Overestimation

This arises in a transaction that includes a trade-in vehicle when more is owed on the trade-in vehicle than the actual cash value of the vehicle. Generally, a customer is led to believe that the dealership is valuing the trade-in vehicle at the same amount as what is owed (thus the customer won't owe anything on the trade-in.) In reality, the secret actual cash value (the value the dealership is really giving the trade-in) is less than the amount owed. The difference is added to the cash price of the new vehicle (or the capitalization costs of a leased vehicle.) By inflating the cash price or cap costs of the vehicle, you the customer are illegally paying more in sales tax and registration. The dealership may also be violating the laws related to selling a vehicle for the advertised price (a dealership may not sell for more than advertised price.) A similar illegal practice may occur when a lease balance is paid off. These are still illegal practices even when the customer is told what is happening.

Scam 2. Packing (inflated monthly payments)

In a packing case, the customer is quoted an inflated monthly payment. Once the customer accepts the monthly payment amount, the dealership adds accessories (alarms, service contracts, GAP insurance, paint/fabric protection, window etching, low jack, etc.) in order to reach the inflated monthly amount. The customer does not realize that the accessories are optional nor that they are paying extra for the accessories (they are led to believe the accessories are included with vehicle or not told at all.)

Scam 3. Rewritten Contracts/Backdating

Often a customer will not qualify for financing upon the terms on the first contract. The customer may be required to increase a down payment, higher APR, etc. in order to qualify for a loan. The dealership has the customer come to sign a second contract with the different terms but backdates the second contract with the date of the first contract. This affects the finance disclosure laws in that the customer is being charged interest for a time period in which the contract is not yet in effect, etc. In addition to making a material misrepresentation regarding when the customer takes the obligation of the new contract, a backdated contract often also violates the single document rule (explained below) because another form (usually called Acknowledgment of Rewritten Contract) has the actual date when the contract was signed. Further, many customers are not told that they do not have to sign a second contract, instead they can choose to cancel the contract and return the new vehicle and have the down payment and trade in vehicle refunded. Finally, a dealership only has 10 days to tell you they want to make changes to the contract or cancel the contract. After the 10 days, the dealership cannot change the deal.

Scam 4. "Gotta Put It All in One Document" Rule

The law provides that all obligations of both parties must be contained in a single document (this explains why purchase agreement are so long in the automobile industry.) Often, dealerships will have customers sign other documents, such as trade in forms that state that the customer agrees to pay any difference between the trade in value and pay off of a trade in vehicle if it is different than the amount on the purchase agreement (and any associated attorney fees). Or, the dealership will agree to make payments on a trade-in vehicle but not include the trade-in vehicle in the purchase agreement. Another example is a "hold check agreement" (see below) in which the customer agrees to pay additional money towards the down payment on a later date. These documents violate the one document rule.

Scam 5. The Deferred Down Payment Scam

Many customers are unable to pay the entire down payment at the time the purchase contract is signed. Dealerships will allow customers to make down payments in payments (called deferred down payments). The code recognizes these types of payments and requires that deferred down payments be itemized, including the amount and date due for the deferred down payments. However, rather than disclosing deferred down payments are required by the code, dealerships will have customers write checks for the deferred down payments and then agree not the deposit the checks until an agreed upon date. As part of this transaction, customers are made to sign a hold check agreements that states what date the checks will be cashed and also have additional provisions regarding any returned checks, thus creating obligations that are not included in the single document (purchase agreement.)

Scam 6. Changes to the Advertised Price

The law states that a dealership cannot sell a vehicle for more than the advertised price (even if the customer is unaware of the advertised price.) What is an advertisement is broadly defined to include window stickers as well as the usual media ads. If a dealer inflates the cash price of vehicle to include other items, that would, in practice, result in selling a vehicle for higher than the advertised price. (Which in addition affects the amount the customer is charged for taxes, licensing & registration fees and finance charges.)

Scam 7. Using Your Language Against You

Civil Code §1632 provides that if a lease/purchase of a vehicle, is primarily negotiated in Spanish, then a Spanish translation of the contract must be provided to the customer prior to signing the English language contract. This law was recently expanded to include Chinese, Vietnamese, Tagalog and Korean. Failure to comply gives the customer right to rescind.

Scam 8. The Whole Truth About Used Cars

Dealerships are required to disclose material known facts about a used vehicle such as if the vehicle was:

  • involved in a prior accident (that caused substantial damage)
  • it was a prior rental vehicle
  • a lemon law buy back (the vehicle was repurchased by either manufacturer or dealer under the lemon law because of a defect)
  • odometer readings not accurate, etc.

They are also prohibited from misrepresenting facts about the vehicle's history (such as its never been in an accident, it was a trade vehicle (when it was a rental), etc.

Scam 9. So is it New or is it Used?

The law requires that a dealership describe the vehicle being purchased as either "new" or "used". A used vehicle also includes a "demo" or demonstrator vehicle (vehicle used by manufacturer or dealership representatives) but often the contract will state the vehicle is "new." Also, some vehicles were previously sold but for some reason returned (usually because the failure to obtain financing) and this vehicle may also be used but is listed as new.

Scam 10. "Certified" Used Vehicles

Several manufacturers and some dealerships have "certified" used vehicle programs. Generally, a used vehicle that passes certain standards is labeled "certified used" and is suppose to guarantee to the customer that the used vehicle is in good working order and free from major structural damage (including prior accidents.) However, a lot of vehicles that don't actually qualify as "certified" under the standards advertised are being labeled certified. Customers are ending up with certified vehicles with frame damage from prior accidents.

My daughter bought a used car in Alabama for 9K, financed by the used car dealer. That dealer sold her note to another finance company, she was late on 2 payments, now the new note holder says she owes 19K. What recourse does she have besides default or chapter 7?

More DMV Fees

I recently purchased a car from a dealership. We paid cash, in full. The dealership is now sending me a letter stating that the "estimated" DMV fees are more than we paid and that we owe them the difference. Is that legal?

Bad business

I bought a car from a used car dealer in Fresno Ca. Initially they told me i was approved for a loan at 20% interest and $357 montly payment. So i signed the contract n drove away in the car. About a week later the bank calls and says i wasnt approved. I was told to call the dealer to see what was goin on. Apparently they failed to tell me they were trying to scramble for a bank to finance me. I had given $4,000 down so when i found out my car wasnt financed i put a hold on the check knowing they were gonna be sneaky n get me stuck with a deal i didnt want, so exactly what i thought would happen ....happened! They tried to cash my check without my knowledge and tried to lock me in a deal for $489 a month at 28% interest. Now they want the car back because i dont want that deal that i never signed for and want $500 restocking fee. It took them two weeks to get back to me! Is it unlawful for them to be doing this? Please help.

Two Different Prices

Hi, I bought a car from a dealership a few months back. They just sent copies of contracts and on one form, the cash price of the car is listed as $18916.59 and on another form the sales price is listed as $14083.41. The total financed amount is $17865.84. Turns out that the car was then and is now worth ~$10,000. Not to mention that they valued the trade-in for thousands more than it was worth. I want to know, is this fraud on the part of the dealership? If so, I want to know if I have grounds to sue and if so, what should I ask for. Thank you for all you do.

Is the 10 day cancelation period for when notice is mailed?

My auto lease agreement has the provision that "Lessee agrees that if this lease cannot be assigned by lessor to a financial institution with whom it regularly does business in terms acceptable to lessor, and lessor gives notice to lessee within 10 days, this lease will be rescinded. Lessee must then return the vehicle in good condition and lessor will then return all consideration paid."

Thus, for a lease executed on October 1, can the dealer cancel a lease just by mailing notice on October 10th (even if it wouldn't be delivered until a later date), or does it have to be received by me the leasee by October 10th?

Also, what would constitute sufficient proof of mailing on their part? That is, do they have to provide a tracking number which can be verified, or can they just write that their office manager mailed it on the day they stated?

I saw that you somewhat addressed this issue to another reader who posted on May 11th, 2007. I looked at the back of my lease agreement, and for notices is says: "Notices will be deemed given to us when they are personally given or ACTUALLY RECEIVED at our address. Notices will be deemed given to you when they are personally given or WHEN PLACED IN THE MAIL, address to you at your address then shown on our records, even though you might not actually receive our mailed notice." (I added the ALL CAPS)

Is this lack of symmetry in notification terms allowed and legal in California? If so, then what proof of mailing can I require from them to see when exactly they mailed the notice?

Mitsu ripoff

I was called in to sign another contract, but I was never told that the finance company had changed the interest rate and raised the cost of the loan. The dealer: West Loop Mitsu of SATX did not inform me that the length of the loan have been extended. I unwitting signed and now I am f----d. There are more unscrupolous things they did, bugt.....

suspect auto fraud

I live in new jersey. My husband and I purchased a car on Aug 20, 2011. At the time I was asked to post date a check for funds I did not hv and promised would have at a later date. Ii am unemployed and I collect unemployment my husband is employed and makes 30,000 but told the sales guy that he made more bc he was asked what was his total income so my husband figured including over time would bring him to 41,000. We took the car home that day without the financing being complete. On the the 31st of Aug I brought my husbands pay stub and a bank check for 6,000. The next week on Sept 3rd I brought another check in for 8000 and signed papers thinking my finance deal was complete bc they said a bank approved. I get a call last week on Sept 15 Thursday. Stating that the deal fell through bc of my husbands income and that I would need to put more money down. I said no. My husband and I told them we want our money back n thats when they wanted to work it out. My husband went back to the dealer this past Tuesday 8.95 to 13 percent. Our credit score was fair n now in the low six. They cashed all of our checks on Sept 7 the n nothing was final. I am now driving around this new car with an expired temp registration and temp plates. I am so distraught and not excited about the car as I first was. We also told we would not beable to get all of our money back if we decide not to keep the car. Is this all legal ashy they;ve done? How can we fix?

CPO Audi Vehicle was involved in accident before my purchase

I bought a 2006 audi a4 CPO from Audi dealership it looked like a great buy 2 years ago since then i have put only 5k miles on it since it is our 4th car. Recently I was bothered after i had the car cleaned and noticed that their was some peeling and bubbling of the paint mainly in the rear trunk area. I quickly took it to an auto body shop which confirmed with me that the car had been repainted and the rear end had obviously been hit some way. I have never had or been in accident with this car, I was never told by the dealer its never been repainted or been in accident but it seems to have been. Its been two years though and i just noticed it but If I have known about the cars repairs I would have never bought the car. It did come with a clean car fax and very low miles when i bought it 16,700 miles. I have about 21,600 on it know still very low besides that I fell that I have been cheated and I dont know what to do.

Now it's a year later and my son lost his job and he Is behind and it's out for repo well I decide to do a AutoChek and find out vehecle was used for rental and we weren't told, also it had to be titled at one time as a Storm Title. What can I do about them not reporting it well I had no idea and they are trying to say they didn't kniw

Certified Used Car

I purchased a 2002 Ford Escape certified used vehicle from Approved Auto of America in Louisville, Ky (502) 772-3333. I have to pay $9,000 for 2 years. I got $1000 from trade in of a 1995 BMW, and put $500 down The day after I bought it, the tire went down and was told the tires were rotten. I paid $50.00 for that, two days after that it was driving funny, like it was going to cut off every time I stopped. After three days of calling the owner, he let his mechanic look at it and he said it was driving on 4 cylinders instead of six. They said they fixed it. Three weeks later, the transmission went out, Mr. transmission fixed through the warranty company and I was out $300 for deductibles and car rental. They kept the car for 7 days going back and fourth with the warranty company. Three days after I got the car back, the right tire rod broke, while I was driving and I hit a ditch, around 1,000 damage on right fender. I have spent 150.00 in tow fees. I am catching the bus. I can't turn claim into insurance company, because I have a 1,000 deductible and don't want insurance to increase. I am very tired of dealing with this situation and have two more years of payments. I bought because I thought certified was a good thing, but means nothing. I could have been killed in this car. The owner assured me he sold only reputable cars. Any suggestions how i can get out of this situation.

i went to a place called pimlico motors in maryland. i went through a terrible 2 months with atleast 5 different cars because they all had issues. since this place was a buy here, pay here thing i had to come up with $3000 down and besides that they charged me that fee with whatever the car was. even though the vehicles had their internet special price and a ticket sticker price of $8000. they say that they have to charge more for the vehicle if i couldnt get qualified through a bank. is this legal, and am i able to get my money back?

Dealer requiring customers to use captive finance choice.

I work at a dealership that is now requiring our customers to use our finance sources ONLY.
If a customer wants to finance with their bank our managers are telling them they can't get the discounted price on the car without using our lender. "If we discount the price one penny, you are required to let us control your financing."
Isn't this considered "tying" by only selling the car if they use your finance?

Had two tradein cars. still upside down with negative equity. had to pay 1000. cash then 2500. down then the dealership wants a hold check for 5000.00 to run through a company called Cenergy. The contract states 8500. down. what happens if the 5000.00 hold check does not clear.

Automobile Scam in Texas

I went through a dealership who specializes in "bad credit" auto financing. I did an online application 8/4/11 and was told that I was approved. I told the salesperson that I would like to use my car as a trade in and that I had $1000 cash. I told him that I would be ready to purchase the vehicle in a couple of weeks. On 8/19/11 I went to the dealership test drove the car and they accepted my car as a trade in, they gave me $2900 for my car and I gave them $1000 cash. On 9/7/11 I received a voice mail from Capital One and from the dealership. I called Capital One first and they asked for my address, employer's address and my income. They verified my car payment told me that it was due on 10/3/11 and they said they would be mailing me out the details of the contract in 7 to 10 business days. I called the dealership back and they said that the loan was "kicked back" to them, it had not been approved. I called Capital One back and they told me that they just got my paper work the day before, that the original application had expired. The finance person at the dealership said that they were going to shop for another deal and that I would need to put an additional 1000 dollars down, is this legal. I have had the car for almost a month. I called Capital One back again and they said that the dealership canceled the contract not them. The dealership was supposed to call me on Friday 9/9/11 and I haven't heard from them. I said I don't have another 1000 to give them and my car payment is due on the 3rd of October and they said that they don't have a contract so I don't have a car payment yet. What should I do?

This sounds like a yo-yo scam where your Truth in Lending Act rights are violated. Sue the dealership.

hi there... my daughter went thru something like that with a car lot here in houston texas, we are now going to get a local news channel for help , since we cant afford a lawyer, but this was with a people credit bank and the car lot.. i think its a scam all together, myself. they sold her a used car for 13k, and the blue book is only 5k, at best... and because she told the truth to the bank, and now the bank dont want to give the check to the car lot, she is with out a car and her money. i hate these crooked car lots..i mean yes, she ruined her credit, because she was young , and needed a second chance ,. just to loose $1700.00 .. its not right.
I hope you get your money back.. call that car lot and tell them "what channel do you watch the news on, because your going to be on it".... good luck.

Hey Hal, I'm a 22 year old female, living in Michigan.

I had just financed a 2002 Honda Civic through my local dealership, and have had it in my possession for 5 days now.

I just checked my mail, and received a letter from the Credit union that supposedly approved my loan, stating that they in fact, did not.

Tomorrow I will be calling my Salesman to clear things up, and see if there is a mistake with their communication with ELGA.

My issue is, they let me drive off the lot without being approved, and he had stated, that there was no issue.
I'm really upset, and need to know, is there any other option besides returning the vehicle and taking my old piece of crap back?

Do I legally need to pay for gas/mileage on the vehicle, and what do you suggest for future deals with dealerships, what to look for, and what questions to ask to bypass this stressful scenario all over again?

Scam 3. Rewritten Contracts/Backdating

I guess that depends on what you signed. According to the description of Scam#3, you have the right to return the vehicle and get refund. In fact, this makes the vehicle used to them and can't sell it as new any more. I would try to renegotiate for a better deal. calll another bank, ex PenFed, lined up another source of financing just in case. Show up early, figure out what's going on quickly. Best if you don't take the car there but have someone drive you. Call the cops file a report if things go sour, figure out next steps when you get home. Take reaks, bring water, expect to spend a few hours there.

RIP OFF OR...IT'S NORMAL?

Thnak you for helping people like me, that is alone in this country (husband passed away in a car accidente, and he was using my car for the first time- the insurance did not pay me for his death; they said that show up 3 days later a "witness" the other party bring and state "she saw the accidente" . I tried to talk to the lady ( the court gave her cell phone) She never ansswered me, and finally she changed her phone number. The accident was in other town, far away from me. I was devasted, couldn't travel there inmediatly, only a week later when I could get a new car.
I wanted to lease a vheicule for 3 years, as I had the other one, my husband was killed. I asked the seller, for me not to pay more than $450.00 montly. He said, as I was not citizen, they will charge me $14.99% interest rate a year. I agreed.
My sate of mind was not good at that moment (crying, sad, etc) and I did not spoke English at that time (only Portuguese and Spanish), so I really did not understood all the things on the contratc they give me to sign. But the price monthly was not going to be $450.00. They said will be $480.00. I agreed. After that, they ad more things that I found out , months later, I did not have to buy it..but was done, was signed the contract.
Other bad thing I found out months later: they did not gave me tha car in Lease. They "sold" me the car! I went back there to talk to them, thay said they can't do anything more, since I bought it, I was paying the $604.00 monthly, etc.. and I did for four years payments on time, and could do it online. Now, for the year 2009, after September/October, after I lost my job and started not paying on date. And this is happened around 5 or 7 times last year and a half. I am 65 years old ( companies don't want to hire a person at my age) so, I do babysiitter, clean house, and when companies hire me to distribute flyers, I get paid. And.. I am a professional in my country; Now, I am stucked here; not so many options. I am late paying my car. Ther Finance Co. have a reason to call me 7 days a week and threath me. They said they will repo my car. I have acumulated , since last September 6, two months without payment. I got a new job now, they will pay me in two weeks. If I loose the car, can't work anymore. Only died. I am frustrated for not having the money. I sake the Finance Bank to send me the ammount I still need to pay for the car, for around 8 months, since they did not allow me to pay online January 2010 anymore.
I was wondering all the time, how many months mroe I need to pay. Inittially , I knew I need to make 72 payments of $604.00, but always they said I need to pay more, because of the fees in LATE PAYMENTS. I asked them "how much mroe" (by phone) at the Bank that represent the Finance Corporation); They never told me. In April, 2011, finnally I wrote them telling them if they don't allow me to see how much I own, I will go to BBB to do a complain. They sent me two pages with a lot of numbers ( very confused). I spent my time, to make a SUM of how much I already paid for the car.

The CAR PRICE WAS: $32.000.00

Down Payment and rebate: $4.000,00

Interests 14.99% year

TOTAL PRICE: $ 43.000.00

NOW; When I summ al the payments I did, the Total ammount was: $56.900.00 ( extra fees for late payment and for cover GAP of insurance for 2 months).

AMMOUNT I STILL OWN: $6.000.00

Now, they want to REPO the car.

Maybe if I can get money to pay one month tomorrow ( I don't know from "where") they will not do the REPO ( I think).

I want to know: IT IS LEGAL TO CHARGE ME SO MUCH?

I don't know how much I already paid in CAPITAL for the car.. and I don't know how much I have paid for Interests. I only know they said I still did not pay the 72 months. I need to pay until 2012.

THE CAR WAS BOUGHT IN DECEMBER 2005. I AM NOT SURE, IF THEY ARE COUNTING I PAID 65 MONTHS OR 66. ( I know I am late July & Agost. September is in advance ( so now will be 3 months) . Every day 6 of each month is when I need to pay.

Since you don't owe that much on the car, you might be able to refinance the remainder of the loan. You can get a loan for $6500 and spread it out over 3 years. That should bring the payment down to around $200/month. You might even be able to do this with the company you currently have for the loan. Call them and explain how you lost your job and don't make that much money. Tell them you'd like to refinance the balance at a lower interest rate and over a 2 to 3 year term so the payment can be affordable. If they can't do it, shop around with credit unions and banks to see if you can refinance through them.

Dealerships mistake

HI, i gave the dealer my info and got my dad to co sign for me. She took all out info and called the next day saying i was approved.I went in and picked out the vehicle, she layed out the numbers for me which said how much downthe legnth of the loan and how much a month an a big X under trade in. I go in to see the finance person, i sign the warranty paper work, the paper theat states i will keep insurance on vehicle and the bill of sale, which still requires my fathers signature. He said the will overnight it to him. He gives me a copy of bill of sale for proof of vehicle purchase as he specifically said. Then after he hands me a copy of bill of sale. they say theres a mistake that the bank said i was supposed to trade in a vehicle. I told them i didnt have a trade in which the saleperson specifically knew because when she layed out numbers for me there was a big X under trade in. So the said they had to call the bank the next day to see if the trade in part could be taken of. But technically isnt the vehicle mine since i do have a signed bill of sale from the finance manager?

Sign revised contract or return the car

I purchased a new vehicle on the 1st. Dealer deposited my down payment check on the 3rd. I got an e-mail from the dealership on the 7th saying that they gave me a $1000 rebate that they shouldn't have given me. Dealer overnighted a revised contract, which removed the $1000 rebate, and asked me to sign and return it to them. Basically, vehicle price on the revised contract was $1000 higher then the original contract. I would be paying additional $17.99 per month for 5 years. I spoke to the dealership and they asked me to sign the new contract or return the vehicle to the dearlership since they are loosing money on this deal.
Question 1 : Am I obligated to sign the new contract since the dealer gave me a discount they shouldn't have?
Question 2 : If I refuse to sign the revised contract, can they take the car away?

I bought a car (6-10-2011) from a person that "supposedly" works for a dealer. He told my boyfriend that he can help him get a car from action at any price and that "supposedly" he has a dealer license, my boyfriend ask for a car no more that $4000 when the guy call him saying he has the car already a 2003 VW Jetta with 96,000 miles, my boyfriend went to the guys house to check the car. The car ways the way he told us it was, it need it lost of repairs i spend $1000 to repair the car, as soon as the car was fix he ask us $390 for the title process we told him that he offer his self to help us to get a car without any other charge. he started charging us as a dealer buyers, i ask him for the proof of the action that he pay $4000 for my car he refuse to show it and he didn't what to give me a recipe of proof i give him $4000. I refuse to pay him more money and i went to investigate this guy at the Nevada dmv and i found out he doesn't work for a dealer and he doesn't have a dealers license to sell cars. I went back to him and ask for a purchase order he give it to me but he didn't wrote on the for that i own him $560 of tax, document fee and title, only that i pay him $4000 cash for the car. I did a police report but it end up me paying him the $560 what can I do to get the $560 back the day I pay him the $560 was (9-8-2011) since 4 months ago I haven't touch the car.

I live in Honolulu, Hawaii. I bought a car from an elderly person on Aug 16, 2011. She signed the title and gave it to me. Right after she sold the car she left the island on August 19, 2011. I know that I have a 30 days window to transfer the title on my name. I went to the Kalihi City Hall (Dillingham) on Sep 2, 2011 to change the title to my name. At the counter the service personnel told me that the previous owner issues a duplicate title on Dec 2008 which I was not aware of till then. She asked for the duplicate title which I don't have with me. I contacted that person's phone number after that and asked her for the duplicate title, the only thing she sent me is the top portion of that duplicate title which is signed by her. She didn't send me the bottom portion which is the duplicate title. After I receive that I called her hundreds of times and also left message but didn't hear anything back from her. I don't have any other of her contact information.

Please advice me what I can do in thing situation to change the title to my name.

I only thing i have is the original title that she signed.

sticker price is different than sales price

i purchased a 2011 camry last week and i just noticed on the contract that the sales price is much higher than the asking price and also they jacked my trade in value up and showed an equity when really it was worth 7500 and plus i put 500 down. can i give the car back and cancel the contract seeing they lied about the price.

Lift my car tags from a dealer

The dealership was trying to charge me $400 to get new tags for the used car rental vehicle they sold me. My tags would have cost me $115 if I would have got them myself. I told them I was not going to get robbed and that they were crooks and I was going to get my tags myself. I now cant get my tags myself because these crooks but a hold on my tags. Is this legal?

California-Dealer did not disclose damage on NEW car

I recently purchased a NEW VW from a dealer in San Diego.
I am moving out of the country, so I took it to CarMax to see what they would offer for it.
During the inspection they notified me that the car's hood had been repainted.
This was not disclosed by the dealership and CarMax said it would negatively impact the value of the car.
Is this legal?

LEMON-used car in missouri

A dealership sold me a bad car that broke down 2 days after I had it. He then "suppossably" left town (the owner whom sold it to me), and since he was on a farm they told me he could not be reached. After several call backs I kept getting "oh he just left, but I will have him return your call as soon as he got back in." The VP told me that I dont have to continue payments until fixed but "I didn't hear it from him". He also said that when I heard from him next, it would be the words straight from BOB(the owner). So he changed his story and said that I could pay the taxes on it and he would trade it in. Well I didn't want that, so I kept asking for my money back. Then once the owner was reached he told me to take it to his mechanics and that he would have it fixed. Upon finding out that it was a bad motor and radiator, he told me to pay for it. He knew what he was doing, and created a cheap fix to get the papers signed and off the lot. While test driving it, it kept jerking and he told me that it would need new spark plugs. I told him that the air wasn't working and that the acceleration didn't want to pick up. He stated it was the spark plugs and giggle it causing it to work again. (CHEAP FIX) Turns out that he quoted the price a thousand dollars off and is now making me pay for his mistake. I refuse to return the car and will have a mechanic lein placed on it until further notice. I do want to place a small claims case under the UDAP act, but I'm not sure how far I could go.

Hello. My husband brought a BMW 540i from a dealership in Virginia beach. He also finance it through the dealership. His interest rate is 29.99% and he loan is for 48 months. He has a monthly billed of $297.90. Well he just recently decided to go start making his payment at the dealership and not on-line. Well he notice that the amount his has been paying on the car is more going towards interest. For example, One month they will put $140.00 towards interest and the next month they would put $200.00 towards intrest. So in the end one month only $90.00 is going towards the principal of the car and another month maybe only $99 and sometimes only $140.00 is going towards the principal of the car. He got the car in August 2010. He got the car for $8,335. It was originally $10,835, but he put down $2,500. We are both confused. Why does the principal keep changing and why does it seems like they are taking out more than 29.99% a month. Are we doing the calculations wrong or something.?

Principal vs Interest

Simple interest loans can become very confusing and difficult to understand. The most important thing that you need to remember is your interest is compounded on a daily basis; per diem. The amount of interest that you pay is dependent upon your loan balance. As your loan balance lowers, the amount of interest that you pay (daily) will also decrease. Simple interest loans are designed so that you pay the majority of the interest (29.99%) up front. There could be many reasons for the fluctuation in the amount of interest that you are paying with each payment however, my first question to you is have you been late on any of your payments? I would be willing to bet that given your balance and 29.99% interest rate, you are paying approximately $8 per day in interest. Now if you're making your payments on a monthly basis you need to take the $8 and multiply that by the number of days that has passed since your last payment. This will give you the amount you should have paid for interest on that one payment. This may sound crazy but what you need to do is pick a day of the month to make your payments and stick to it no matter what. Here is a scenario that may help you understand: Let's say in January you made your payment of $297.90 on the 15th but then in February you made the payment on the 20th. This would mean that 36 days have passed resulting in paying $288 in interest. Now if you were to have made the payment on February 10 you would have paid $248 in interest. Again, the daily amount of interest will go down as your loan balance goes down and you will start noticing more and more of your monthly payments going towards the principal as your loan matures. By the last 7-10 payments you will be paying next to nothing in interest. I would suggest that you start making your payments with an equal number of days in between without fail. Also I would also suggest that (when possible) you add any amount of money to your scheduled payment. Your payments are $297.90, if I were you I would add $10 or just round it off to an even $300. Two things will happen when you do this 1) anything above and beyond your scheduled payment amount goes strictly to principal causing your balance to decrease quicker 2) any amount paid that exceeds your scheduled payment amount, comes off of your next payment amount. For example, if you paid $300 instead of $297.90, your next payment due would technically only be $295.80. If you follow these two simple steps you will be ahead of the interest game and in the end you will have saved yourself a fortune. Just keep in mind to pay on the same day each month, if the 15th is comfortable for you, then pay on the 15th EVERY month; don't pay earlier than the last month and then return on the 15th the next month because you will then have more daily interest accrue for the next payment. Try to add any amount of money when possible to your monthly payment, even if it's only $2.10 to make it an even $300. Never, never, never skip a payment no matter what this will cause your interest per diem to sky-rocket. Ask your finance company what your per diem is next month AFTER you make your payment, this will give you an idea of what amount of interest you will pay next month and if it is different than what you calculate, call them and have them explain why! I bought a new boat 10 days ago and was under the impression the motor was new. They didn't tell me the boat was a 2011 and the motor was a 2008. The motor is unused I think but it is 3 years old. My car loan was covered and I went back to my uncles dealership hoping to spend a little more on a trustworthy relationship after the accident. I bought a 2005 Nissan altima with 88,000 miles for a total of 13450 including $1800 warranty. A week later I brought it up to the repair shop complaining of squeaking noise when I went over bumps. Service said they didn't hear it. I brought the car to a mechanic and they said it looked the front end had been in an accident judging by loose hood and rust spot. A week later I called complaining again an was told to bring it up. Before I got a chance to bring it up, the shifter would not shift out of park. I had to use shift release to put in reverse everytime I was driving ( dangerous, especially because I am a case worker who drives children for a living). I brought it up to dealership where they said they would fix squeaking and shifter. It took a week longer because part took longer than expected. I got a call Thursday saying it was ready and I told them I'd be free Sat to pick it up. I got many calls while with clients reminding 'me to pick it up and if I picked it up that day I wouldn't need to pay 200 (warranty what?) so I rushed over, picked up the car and was forced to be late for a client to save 200 even though I shouldn't owe anything (shop wanted loaner back). On my way home squeaking was present which they said they fixed and suddenly moonroof would not open. I decided to trade in car. Everythings going hunky Corey with my uncle until I realize he is overcharging 'me 1955. My payoff owed was 13450 and my used trade allowance 11495. Can he lawfully skimp 'me $1955 of a car owned for 45 days? Is there a lemon law for the altima I can use? He is now selling the altima for 12950. Am I able to sue due to negative equity/over allowance?

Warranty

There are many questions that I would need to have answered before I could help you with the $1955 concern that you have. First of all, where did you come up with that total? You stated that the insurance company paid off your wrecked vehicle so why would you get a trade allowance? Also, the warranty would need to specify what is covered. A general warranty sold to a used vehicle usually covers the engine and drive train which does not included a squeaking noise. So if they were to have fixed the squeaking noise, chances are it was not covered under your warranty and that is why they were going to charge you the $200. They probably waived that fee because you were family of the owner and you had just purchased the vehicle. There is no lemon law on a used vehicle in any state. There are exceptions, but they involve very strict guidelines and unfortunately, you would not qualify. If you signed a finance contract with him and gave him back the vehicle without honoring the terms (for what ever reason) then yes, he has the right to keep your trade, down payment and in some states could actually charge you for the use of the vehicle. He could also legally pursue you for the remaining balance on the contract plus any fees he wishes to add. I hope this helps. Lemon Grove Cycle Salvage

Over the last 5 years I have had 5 Harley-Davidson motors to Larry at Cycle Salvage to re-build. When I finally got the motors installed and tried to start them I found that there were major problems of things not done or done wrong. I have had to tear these motors completely apart again to try to fix these problems. What can I do?

Victim of Buy here pay here car dealership fraud

My sister bought a car worth about $5,000 and ended up with a loan with about $13,000 additional interest cost for a total of about $19,000. They paid their payments dilligently and have reached the end of their contract. Now they are saying she owes an additional $420 (approx.) that is not in the contract. My husband is an accountant and he called them and went through the contract with them over the phone and they admitted that they were wrong and she does not owe this amount. Well, a few days later they renigged on this saying she still owes this amount and will not return her phone calls. The "Dealership" just moved out of state recently before this happened and she has been told she can't get legal help in her own state of Indiana. She can not get her title until she pays this extra amount and it is very difficult financially for them to pay this extra amount. What can she do? She has her contract and the record of all her payments. They don't seem to care about how they are treating people there.

Lessor of car went bankrupt

My brothers leased a car through a CA Lessor about 10 years ago, the lease was paid off but the Lessor went bankrupt and therefore didn't send in the paperwork to the DMV. There is no pink slip and the registration is in both of my brother's names. They cannot sell the car nor give it to us as there is no paperwork. We are in possession of the vehicle but cannot re-register the car in our name. Both my brothers must re-register it every year for us. The registration still lists the company they leased the vehicle from; but there is no way to contact the company. Is there anything we can do to get this squared away once and for all.

I just boght my used car at dealership but they didint tell me my stiker expired in 30 days and in my down payment I payed for plates and regestration and stiker what do I do

Plates

Depending on which state you live in, a dealership with either issue you a 30 day tag and issue you a memorandum title to register the vehicle and get your own plates or they will issue a 90 day tag and prepare the paperwork for you. If this is the case then they will receive your plates in the mail and will contact you. Since you were issued a 30 day tag and they are now expired, I would go back to your sales person and have them follow up immediately. There are certain time frames in which they must comply, and if they don't then you have an actionable cause against the dealership. Be nice yet firm when visiting the dealership and do not leave without the answers that you need. If you are unable to drive the vehicle due to improper registration, demand a dealer plate to use until they complete the correct paperwork, and if they refuse I would then ask to see the title or the paperwork that they have submitted to the Department of Motor Vehicles. If they can not produce this paperwork, especially the title you have every right to leave the vehicle there and get any money you have paid to the dealership; including down payments and payments that you have made. Bad Transmission

I Just bought a used 1997 grand prix from a dealer yesterday. There were minor little things wrong with the car which I brought
up to the dealer to deduct from his asking price. He was asking $3000.00 which I talked him down to $2550.00. Today when driving the vehicle The overdrive in the transmission is completly gone. After bringing it to a transmission specialist the tranmission needs to be completely rebuilt. I called the dealer and he said it was as is ,and its now my car, my problem! I feel he should take the car back and give me back my money or pay for the transmission or portion of it. Any suggestions?

We have been in talks with a dealership and negotiated a contract on August 13th.
We live in CA and purchased the vehicle in ID
We sent in 500 to 'hold' the vehicle on August 13th.
Also faxed on August 19th, drivers licenses,insurance card and military discharge papers which they were going to make sure qualified us for an extra 500 military rebate.
We arrived at the dealership and Purchased the NEW vehicle yesterday for agreed CASH price (2000 manafacturer rebate and the 500 military discount). Signed all the papers and left with CA DMV transfer forms.
drove 700 miles home.
Now It's August 31st.
Today i get a call from salesman.
he says he was mistaken about the rebate and he wants us to give him the 500 military rebate back because it is only for 20 year lifers or current military personal. When asked what he would do if we said NO he had no response but asked that we THINK ABOUT IT and give him a call back,
Do we owe the money back? They had 10 days to verify the rebate before we arrived for final contract and delivery.
They agreed to the final contact.
they accepted the cashiers check.
I find it hard to believe they were unaware of the restrictions or have not given the rebate to anyone prior to this contract.
any advice would be appreciated.

Military Credit

A basic answer to your question is "No". A dealership has 4 days after the signing of the contract to contact you and discuss any necessary changes and problems with the terms. After the 4 days, there is nothing they can do, the contract is legally binding. They do not have the right to repossess the vehicle or demand that you make any changes in the contract. If I were you, I would immediately call the finance company and tell them that you have misplaced your documents and need official copies to insure that these changes have not already been made without your knowledge. getting my down payment when i take a car back

I LIVE IN Arkansas i bought a car from a pay here dealer drove the car 5 days they had to tow it in when the transmission went out. Then I found out they lied and said the car had never been wrecked when in fact car fax said it had been in a rear en collision. Then when I get the car back I take the papers to the revenue office and they say the dealer cant legally sell me the car because their name is no where on the title so they won't let me license it. So since I am tired of the mess I take the car and park it on their lot and put all paper work and keys in their drop box. A bout a week or so later I get a letter saying they repossessed the car. I called them and told them no I returned it because I could not license it. So for 2 years I have been trying to get my down payment back and they say no because they repossessed the car. Am I screwed or do they have to give my money back?

We were of course talked into much more, which is a given at most dealerships...the finance manager was very pushy and we made the mistake of telling him we had just gotten a lump some of money from family selling land in minnesota...after running credit he said we needed a bigger down payment-$15,000!!! we argued and were eventually talked into going to the bank and getting a cashiers check for that amount. we were told with that amount down our payment would be $580 a month. we insisted that was way to much and we could NOT afford that!! (with insurance it would be more) then he told us he could help fix our credit and we would be able to refinance in 3 months and lower our payment to 300.00 like we wanted...he said we would receive a credit card in mail within that 3 months, with a $50,000 limit. I said no, but my fiance' believed him...He told him it would cost him $1000.00. we gave it to him. In the following 2 months, he called on several occasions and said it would cost more. my fiance' met him and gave more money to him. another time we sent one of our emplyees to meet and give him MORE money... he then called and asked to "borrow" money for a DUI that he got!! The total amount of money given to him was $4600.00....!! we actually referred a friend, and he did the same with her. She gave him almost $10,000 to "fix" her and her boyfriends credit (also called her and asked to "borrow" money from her) It has been a 1 year and 8 months now. He did not fix anyones credit and despite phone call after phone call, we got the run around...over and over...my question is: Is he obligated to give back any money he took from us? Is chevy responsible for their employee making verbal promises? (since we based purchasing the car on his word-that we would be able to refinance in 3 months and now we cannot afford such a large payment) besides being ignorant and trusting this con, are we out all that money? we have records, witnesses, and documented calls...Please Help!! Refinance after 3 months

I am going to address a few of your concerns and I am going to be very blunt and answer as honestly as possible; you asked for help. You stated that you were "talked" into spending much more. This can only be blamed on you and your fiance'. If you can't afford it, you can't afford it and if the salesperson is too persistent, you could have walked away. The same goes for the $15,000! My question is, what kind of vehicle were you purchasing that your payments would be $580 per month even after a $15,000 down payment? Were you able to get the clause that the finance manager promised, that you would be able to refinance in 3 months? If so, this is legally binding and you would be able to pursue him for breech of contract if this clause is not being honored. The same question goes for the $1000 for the credit card; is it in writing? What was the $1000 for? Did you get receipts for the money you gave him that was specifically for the credit card? Did you ever receive the credit card? Did the $4600 include the money you gave for the credit card or was this money he wanted for loans? For the money that you loaned him on a personal level, depending on the agreement (be it verbal or written) you have a strong civil suit against him. In California you can file a small claims case for up to $7500. I have to be honest and say that you would have a claim against the Chevrolet dealership for the finance managers actions however, it doesn't help your case that you referred a friend and set them up to be scammed as well. Bottom line is, you signed the contracts, you gave more money than you wanted to, you purchased a vehicle you knew you couldn't afford and even went as far as loaning him money for a DUI! No one can 'fix' your credit but you. Bad credit is obtained by not paying your bills, good credit is obtained by paying your bills unless someone is going to pay them for you, how can they truly say they can fix it? You do have a civil case for the money you loaned him, and I would think you would have an actionable case against the dealership and if I were you, I would contact the corporate office first and explain to them everything that has happened and allow them to be the liaison between you and the dealership. However, you are going to have a hard time finding a judge who is sympathetic to your situation when you allowed yourselves to be blatantly taken advantage of. I don't know if I completely agree with this. He claimed he could fix your credit. He took money from you to do it and never delivered. That's fraud. He's probably scamming other people as well. His employer may be aware of it, though I can't imagine any dealer condoning this type of behavior.

The first thing I would do is take this to the police and file a criminal complaint. If they decide there's enough evidence to make an arrest, the next step would be to see an attorney about a civil case against the dealership.

no title/dealership shut down/no response from bond insurance

I bought a car from a dealership. I paid my car off a month after purchase but never received my title. They kept putting a temporary paper registration on my car month after month until this last April, where after numerous attempts of trying to contact them, all contact stopped on their part. The dealership soon after shut down. I then filed a claim with the dealership bond insurance to try to recover my money and or title. That was months ago and nothing has been produced. Should I be receiving full pay back as I have asked for or do I have to wait until the bond insurance recovers my title. They did find out that my title is with a middle man company that the dealership had purchased several cars and are telling me that they will wait for that companies response, however, this was at least 4 months ago. Can I get full reimbursement from the bond insurance co. as I have asked in my claim? I also have filed a claim with the Utah DMV and they have forwarded it to the attorney generals office as a court matter of which they have proceeded and have a criminal suite against them. In the mean time, I am stuck with a car, without a title and can not drive or sell it. What can I do to speed up the process and get my money back and/or my title? Is the Bond insurance responsible for paying me back or if not, who would is?

In Nov. 2010, my dear friend purchased a used vehical in which she paid in full with cash. The two of us made the oral agreement "get a job..pay it off" I am a single mother and lost everything in a nasty divorce. I greatfully agreed! I found a job. In this situation there are two options, you would need to secure yourself a loan in the amount left owing to your friend and pay her in full, or she would have the right to sell the vehicle however, she would be required to give you the amount of money you have paid her in payments, any repairs you have made and the money for the registration. You would not be entitled to any money you have paid for insurance if you have been driving the car for almost a year now. I recently bought a CERTIFIED 2007 VW Jetta back in March of this year. We decided that we are going to use this as our primary vehicle so we went to trade it in for a newer Jetta with lower miles at another dealership. As they were appraising our car we were informed that it had been in an accident. This was definitely news to me since I was very clear when I purchased the vehicle that I want a vehicle with a clean record as I have 2 kids that will be riding in this vehicle frequently. I called a different VM dealership instead of where I bough the vehicle and asked there policy on certifying a vehicle tahts been in an accident. I was told that they are unable to certify a vehicle if it's ever been in an accident regardless of the dlooar amount. I then went to the VW dealership where I bought the vehicle and explained my situation. They stated that they did nothing wrong and they cannot by the vehicle back from us but we can trade it in for another car on their lot although they will only give us $8K for the vehicle even though we purchased it for $15K 5 months prior. Yes. They have fees to pay in doing the paperwork. They pay someone to fill out the papers, and often a runner to pick up and drop off the paperwork at the clerk's office. There is probably a limit as to how much the can charge, but depending on your state, $200 sounds about right. You could call other dealerships and ask what their processing fees are, if you want to try to pay less. But if you want that car, you will have to pay the fee.

VIN number shows different model year than contract

Hi, I have a question about a car I'd bought last year and maybe it's nothing, but whenever I take my car in for an oil change they scan the VIN and say it's a 2009, but the contract on the new car I bought says 2010, as does the registration for the vehicle. Have you checked to make sure the vin on your car and the one on your contract are the same? They might have mixed up paperwork. The vin is made up of numbers that verify the date and location of the vehicle. It is correct, so there is a good chance the paperwork is for a different vehicle. Which means your plate is probably for a different vehicle too.

How do I know if a contract has been voided. I returned a car to the dealer because the financing did not go through but we signed a contract for a high interest rate. How do i verify if I return the car and he agrees that im released from the contract.

I would ask the dealership for a copy of the "back-off" paperwork. This is paperwork that is kept in the file for a period of time stipulated by state law. It allows for the dealership to prove why they are not responsible for the taxes etc. if a sale is rescinded. You could also ask them to put something in writing, if they refuse ask what they have to hide!

Advertisements in selling used vehicles

(GEORGIA) I had a used car lot pull my credit report to see about financing a vehicle they have on their lot on a Monday. After a few days they said I could come and get the vehicle with a little money down, so I tell them I will be there on Saturday to get it. I call to make sure it's ready and they said they can't get it started and there are electrical issues and are trying to get it fixed for the last week, but they continue to advertise the vehicle everyday for sale. Hello, my husband and I traded in our 2004 tarus to get a 2004 tahoe on Aug 19, 2011 and 2 days later they asked us to come back and resign a contract because the first contract didn't go through. By that time we found out the steering on the car was messed up and would cost us about $700 to fix. So we decided not to resign the contract because the car was messed up when they sold it to us. Now the car dealership said we can't get our car back and we returned their tahoe. So they have both cars and they saying we going to have a repo on our credit when we didn't even resign no contract and the first contract didn't go through. We have a lawyer but we haven't seen him yet we go see him Monday afternoon. Is it possible they can keep our car without giving it back to us when we don't have a contract with them any longer? Someone please tell me something...

I was just 2 hours late to work because the used 2007 Pontiac G6 I got just a month ago had a tire problem. The tire completely came off of the car and was rolling next to me on the road. Not a typical flat tire, the treading completely ripped in a circle and when I stopped to see if I could simply put on the spare there was none and not even a jack to lift the car with. My question is, can a dealership sell you a used car(charging additional balloon payments) without even having a spare, jack, or tire iron in it??? To answer your question bluntly, yes the dealership can sell a car without a spare and a jack. You being pregnant has nothing to do with the sale of the vehicle. You would not have any action against the dealership. Kelly Blue book offers their services free of charge online, and you have the option of doing this research before you signed the contract. You also have the right to take the vehicle to a private mechanic who would have pointed out the bald tires.

Financing fell through, dealer is demanding I pay $750

I traded in my car (vehicle A) for a used car(vehicle B). I owed $8,400 on vehicle A and the dealership offered me $7200 for the trade, leaving $1200 to roll in to the new car loan for vehicle B. When the finance manager joined the conversation, he asked me what our monthly net household income is, specifically not asking for my sole income. At this point my husband told the salesman and the finance manager that he would not be co-signing on the loan and that it was only going to be in my name. If the deal couldn't work in my name, we didn't want to waste their time since that was not an option. The finance manager ensured me that it was standard loan practice to ask for household income. I told him $4500, which is my salary of $2,000 and my husband's salary of $2,500. Vehicle B was sold to us with a contingency clause for bringing the car back should the financing fall through. 8/15/11 was the date I "purchased" vehicle B, and today, 8/25/11, the dealership contacted me stating the financing fell through and that a co-signer was required. They state that household income can't be used, and it has to be my specific income which my paycheck stubb did not support.

My husband agreed to co-sign the loan, however he also has poor credit. My husband called the original salesman to find out the status on the loan, and was told it was approved, and to come back to sign the new loan. Once we arrive at the dealership, the finance manager meets us and explains that the lender has required $500 cash to make the loan fund. We explain that we don't have $500, and if that was the only option then we need vehicle A back and we handed the keys back to the finance manager for vehicle B. He responded that we would need to pay $750 for vehicle A, because the dealership had reconditioned the car. We explain that we don't believe we should pay this amount. At this point, we left with vehicle B because the dealership would not produce the keys for vehicle A and we had to pick up our 7 month old baby. On the drive back home, the finance manager called me and said the down payment for vehicle B was actually $600, and then a minute later as he re-read the terms changed that amount to $690.

The dealer is demanding we choose between two options:

Pay $690 to fund the loan on vehicle B, and keep it.

Pay $750 to pay the reconditioning costs on vehicle A and resume the loan.

THis is in Texas. Is this legal or is the dealer trying to scam me? Please help. This is preventing me from sleeping.

Dealership wants 21,900 for a used 2007 Dodge Charger

I just want to know if this was a good or not. I purchased a used 2007 Dodge Charger on 8/14/2011 with 103,000 miles from a buy here pay here dealership and the dealership wanted 5500 down towards the purchase of the car. I gave 3500 up front with the intention of thinking they would take down the initial price of the car due to the hole in the front bumper and the cracked frame in the rear bumper. Having a Lawyer to look over the contract on 8/18/2011 the salesman failed to do so. Now I just want my money back and just to give the car back due to the constant run around. I just want to know am I applicable to receive my money if I signed a contract that did not state that in the clause, plus it has only been one week and I rather put my towards a new car instead.

Dear Hal:

I just stumbled on this website by accident, while searching around for some answers or at least a place to find some answers to my dilemna.

You see, I had an automobile accident on Christmas Eve (of all times!) while driving myself and my wife to her relative's home ~57 miles away to celebrate the Holidays. The accident was NOT my fault, and I was totally exonerated of ANY fault as the party that hit us readily admitted it was his fault to us, the police and his insurance company. I was very fairly compensated by his insurance company in January. Unfortunately, my car was considered totaled. If this wasn't enough, our daughter-in-law suddenly died of complications arising from her recent discovery of ovarian cancer, so I had to take part of the money to send the wife back home (abroad) to support our son in his grief and his wife's family as well.

I took too long starting my search for another vehicle, until it was only "5" days before the wife was scheduled to return home, so admittedly, I was under pressure by this time to find a vehicle & ASAP!

I had dropped by this particular used car dealer the week before, poking around until I spotted a '98 Cadillac Deville Concours that really looked good, but "why" in the world would I want a Cadillac? I STILL can't answer that question adequately, only to say that since I've been disabled the last ten years from intractable pain caused by a spontaneous "burst" compression fracture, when I sat in the driver's seat, which was heated and which I could adjust myself into total & perfect "comfort", I was overcome with a spell to buy the car. I wished I knew WHY I did it, but I did. It was already late Friday evening when the sale was wrapped up. I put $3,000 cash down and financed the balance of ~$1,350 or so (around $116/month for 12 months). Before I sat down with the wife of the owner to do the paperwork, I distinctly remember looking up at her and asking: "Do you check all of your autos out thoroughly before putting them up for sale?" To which she answered in the affirmative. I then asked even "closer": "Did you check "this" car out thoroughly also?" To which I was given "another" affirmative yes. So, with that & ONLY that, I proceeded to purchase the car. Where my HEAD was at that time, I do not remember, but my aching back was longing to get in that seat again!

I drove the car straight to where we were living at that time, and sat in the driveway trying to figure out all the knobs & switches when suddenly, the battery went dead! I had only had the car lights "on" for no more than 15 minutes. I called the dealership back the next day and explained that I had had the battery checked at Sam's & as told it was defective, but I don't remember "what" the defect was: perhaps a bad cell. But the owner's wife was adamant that NOTHING was wrong with the battery, and she was "unapproachable" and "outspoken" on this point. I saw I was getting nowhere. Though the car continued to start up okay after I jumped it off several times, I STILL wanted to talk to the dealer's owner but felt I wouldn't get anywhere. I knew the brother of the owner as I had cashed personal checks there for over year and he said that he would talk with his brother and for me to go back the next day. I did. But HE was outspoken, unapproachable and I saw I was getting nowhere fast, so I just left, not really knowing what to do.

The following Monday (the wife was due back at LAX on Wednesday evening) I took the car to Meineke to check the fluid levels, change the oil, & generally do a walk-around inspection: something I SHOULD have done MYSELF "before" commiting to buy the car. He found a serious oil leak around the oil plug but said it was easy to fix and replaced the plug. However, he pointed out that there were telltale signs of a REAL serious oil leak around the main seal or "somewhere", he wasn't exactly sure. He also pointed out to me that the right front wheel had "play" in it, which after showing me, allowed me to grab the tire and pull in and out with my top & bottom hands. There WAS some play in it, to be sure, but I judged I had a little time (maybe 6 months to a year) before it would need repairing or looking into it further.

AFTER I picked the wife up at the airport and we were back home, a week later, I noticed the water level was seriously LOW, so I topped it off, wondering if the Meineke folks had done so, but then I was SURE they had done so because they TOLD me so. But from THAT time until the first of July, '11, I had to keep adding antifreeze about every other day or so. It was getting expensive. A friend of mine had checked the system for a "head gasket" leak with a specialized instrument filled with a special fluid that was held in a special device that itself was sealed from outside air as it was held against the coolant reservoir. He conducted the test several times and each time it came up with the same results. It colored the fluid a "light blue" indicating there WAS a head gasket leak, small, but definitely a leak. So I continued to drive the car and add coolant every other day when it got low. UNTIL, June/July, I was driving near Loma Linda when suddenly a thick vapor was seen coming out of the air vents. Not knowing what it was, I told my wife to get OUT of the car. Then it stopped as fast as it had started. It had NO particular odor, not at first anyway, so we both got back in the car and proceeded to drive down the road, when suddenly, the cloudly vapor started coming out of the vents again. So, I pulled the car into a small private drive entrance to a mobile home park. I stopped the car and we both sat on the sidewalk musing as to what we should do next. We decided to start the car again, only after doing so, we saw NO leaks UNDER the car or ANYWHERE under the hood or in the car. Puzzled, we both got back in, I turned the car around and turned right onto the road we had been traveling, when after about .1 of a mile, I suddenly started screaming with horrible pain at the top of my right foot. I couldn't stop the car FAST enough and after doing so, I opened the driver door and pulled off my right shoe as fast as I could, only to notice I had suffered a "3rd degree burn" on the TOP of my right foot, so bad, in fact, I had to be taken by ambulance to the Loma Linda ER for treatment. I was in terrible pain. I was advised by Emergency Room staff to take the folks who sold me the car, to Court for a settlement.

Well, I've left out one VERY IMPORTANT piece of information in all this. You see, after my wife returned from the Philippines, she was hired the first week in April, as the manager of a home for mentally ill/mentally incompetent & homeless folk, which she held until the last of May. The FIRST of May, May 2nd to be exact, I went into the hospital ER for a kidney stone attack. I was sent back home & 10 days later, I was back IN the ER again. Friday of THAT week (May 13) I underwent laser surgery to remove the stone. Three weeks later, after the stint that had been put in my right ureter was pulled out in the doctor's office, 24 hours later I was very sick and back IN the hospital with MRSA (Methycillin-resistant staphylococcus aureus) & septicemia. I could have DIED with this "superbug" stuff and didn't discover how sick I had been until later. Anyway, I spent "5" days in the hospital with THIS stuff: from June 4 - ~June 9, 2011. After being released, I was back IN the hospital AGAIN on July 22nd for another surgery that went awry with complications, and was sent home with a indwelling Foley catheter, and another stint that was "surgically" implanted THIS time and STILL REMAINS to this time.

WHY am I telling you all this? WHY am I going into all this detail? Because, I wanted you to know that I've been very sick during this time, which has further hampered me from being able to "competently" attend to the problems surrounding this "lemon" used car, and additionally, never my wife NOR myself have had enough money to "sink" into this sinking ship of a car -- not even since she started working in April of this year. I was IN and OUT of the hospital ALL during the month of May and into June. After being discharged in June, she LOST her job and we had to scramble to find another place to live, not independently, however, since we've been living with "another" older couple since June. In addition, about the same time the car burned my foot when driving down a local street in Loma Linda, the "cataracts" in BOTH eyes had gotten to the point I had already "voluntarily" given up driving at night, and was ALMOST ready to give up driving COMPLETELY when I suffered the burns to my right foot. SINCE that time, we haven't had ANY money to PAY the used car dealer on the $116/month note I took with them at the time of sale, so I'm NOW "3" months behind and constantly wondering WHEN they're either going to FIND and REPOSSESS the car (which is in the driveway of another friend's house that's nearer the dealer's location) OR Sue ME for the late payments or perhaps the entire BALANCE. My left eye (which was the worst at that time) was operated on about 3 weeks ago YESTERDAY Monday, August 22, 2011, and the surgery was a SUCCESS, as I now have 20/25 vision in that eye. But I STILL have to have the same surgery done on my RIGHT eye now, and I'm only waiting for the surgeon to say WHEN.

In the meantime, I decided to write -- write SOMEBODY for HELP and/or ADVICE in knowing HOW to deal with this problem. Maybe I have NO RIGHTS AT ALL and have lost ALL I put in the car ($3,000 CASH) to begin with and have a LOST CAUSE. I don't know. I've been a member of Prepaid Legal for almost TEN (10) YEARS NOW, and have accrued approximately 300+ hours of "free" litigation time through the plan for ANYONE who sues ME, or so it's SUPPOSED to be. I spoke with an attorney this afternoon again regarding the situation and told him if I could even only recover 2/3 or $2,000 of my original $3,000 I put down on the car, and THEY SELL IT or TAKE IT BACK or WHATEVER, I would be happy - happiER than losing EVERYTHING - THAT IS!!

SO, would you PLEASE, KINDLY point me in the RIGHT DIRECTION and tell me WHO CAN HELP ME with my problem vehicle? Can I get ANY money back? Or has too much time elapsed? I've NEVER contacted these people THROUGHOUT since they almost turned a DEAF EAR TO ME with my COMPLAINT THE FIRST TIME! And finally, the brothers: the one who owns a small drive-in market and the "other" who owns the automobile dealership, are both from Saudi Arabia, so I'm hesitant to do ANYTHING for fear I might come up -- well -- you know what I'm getting at. I just purchased a car from a dealership. while I knew it was a salvaged title It was sold under the negotiated ac fix and that airbag was fine even though I suspected it may not be due to a slight crack in the wheel around that area. We also barely made it home with it as they did NOT put oil in it as I had told them they needed to and change the oil before I would agree to buy it . they also told me that all the taxes and title charges were to included in the price on the window AFTER they took our deposit they brought out a contract with the tags and taxes as extra. I will say at this point I havent even had this car 24 hours and I am very very upset . Can I sue what can I do ???

The only way that a vehicle has a salvage title is if it were involved in an accident and the insurance company deemed it as a total loss. An insurance company will automatically deem a vehicle a total loss if the air bag is deployed; even if there is no other visible damage to the vehicle. The salvage title should have been your first clue that there may be damage to the air bag and you should have been given or asked for a certified air bag inspection form. You can still ask the dealership for this form. You would need to prove that the dealership sold this car to you knowing there were problems with the air bag. You should have also had the A/C and oil change clause in the contract before you signed it. If you do not have these conditions in writing, it is safe to say that you do not have a case. The burden of proof falls upon you in a case like this and you would have a hard time proving that the dealership promised you these repairs as a condition of the sale. The first question you will be asked is why you didn't get it in writing if it was part of YOUR negotiations. The fees for the taxes and title work are never included on the sticker price simply because a dealership can not say how much taxes are going to be due before the sale. They don't know if you are going to have a trade, how much your down payment is going to be and how much your interest rate will be. Once again, if the contract did not coincide with your original negotiations, you should not have signed it.

You do have some merrit about it being a lemon. But there are somethings you need to do 1st and should of done before you signed the contract or drove off the lot with it. You 1st should contact the dealership where you purchased the car and see how they will assist you prior to wanting to sue them. Secondly all the things that you requested should of been writen into the contract. As for the taxes and title charges they are not included in the price stated on the window unless it is stated so. And if you already had doubt about the ac, airbag, or oil. You should of checked the oil. And gotten a statement from them that the ac and airbag were in working order or repaired. And you should of read the contract before you signed. The dealership which you don't mention may of made a mistake but it seems like so did the buyer. It funny how people will scam others but when they fail to look at things they already have questionable thoughts about they want to sue right away. I once heard a saying "what goes around come around". And if you really had thoughts or worries about the care why did you not have someone look at it before you bought it.

Overpriced vehicle Dealership wont help

I recently purchased a vehicle from ed shults in jamestown ny.I traded in a 2000 explorer with 500.00 down.The trade in was 3500.00.I purchased a2006 explorer and drove it home that day for 257.00 a month at 72 months.I realized how bad the gas mileage was and called the salesman to see if i could bring the vehicle back to get a cheaper car and better on gas.He said yes but there would be a trade in difference.He didnt say how much.I purchased a 2007 chevy impala that is now costing me 355 a month I told the dealer i could not make a payment that high.I ended up signing the contract and got home and realized when looking at the contract that the start price of the car was 17,995 rather than13,499 tha twas advertised.After trade in difference titles fees and warranty my contract was 25,000 dollars for an 07 impala.This is outrageous,And I explained to salesman that i wanted to stay with the explorer.I was told there is no buyers remorse.I just want to make paymentson thevehicle that isbetter suited with my financial situation.Wha can i do.I have been told I have 30 days to go back and get the explorer back.Is this true?

I can't believe I was scammed

My husband and I went to Franklin Sussex Auto Mall yesterday. We had received an advertisement for a chance to win prizes, and since we've been wanting to trade his sedan in for a 4x4, we went. We had heard great things about them. We got there and sat down with a salesperson to discuss possible trade-ins. We had tried a few times prior, however we were upside down in his finance, and there was no dealerships willing to budge. She told us she would make it happen. She asked what my husband's monthly payment was. She asked how much we could afford each month. I had never heard of this, but she said there were bank people there and that this is how they matched customers to cars. Since we didn't think they'd be able to help us, we went along with it. She came back and showed us a car we qualified for. We didn't like it, but we did test drive it, as we thought our options were limited. We asked for different options, as well as, for the price of the vehicle. She told me she didn't know the price, just the monthly payment is what we wanted. I didn't like this answer, but we proceeded to look. This went on and we finally agreed on a car. They kept focusing on monthly payments and would not give me the MSRP. I left my husband for a while, so he could sign everything. I asked the salesperson, again, for the MSRP and she told me she was not a numbers person, but another person finally showed me two numbers. The first was $21,1990 and that was crossed out. The second was underneath and was $19,990. He said they gave us a $2k deal. They also agreed to pay off the remainder of his current finance. We thought that was great. I kept asking how much a new version of the vehicle we were buying was and no one would tell me. They switched the plates, it was already after hours and we left in the pre-owned vehicle. We arrived home and I input the VIN number into the internet and an advertisement for the SAME CAR (same VIN) for $16,995 opened on my screen. Needless to say, I printed it out, along with a mini powerpoint I put together, stating the 3 laws the dealership broke. They were closed today, AND I was supposed to go out of town, but I cancelled that trip, so I can arrive at the dealership tomorrow, at 9am. My collected, unemotional thoughts are to tell them to put the plates back on the sedan, refund the minimal amount of down payment they squeezed from my husband (his August payment on the sedan), and be done with it. Does anyone have any thoughts or suggestions?

I had signed a contract on Thursday 8/18/2011 with a dealership and included financing through them. I recieved a call the next day that there was a problem with my equity so I was to go back down there and rewrite a new contract that included a 9% interest rate jump to a 14% and they also required another $1000.00 down payment. In total they have $4000.00 and I do not have the vehicle. I said I want to cancel the contract, family emergency has occured and he said no. MEANWHILE...how can I be bound to a contract when they have no identification on file (not even a license), no income verification, nothing. They only have my signature and social. Is this legal?

Undisclosed Information at time of Purchase Whats our Recourse

Hello - We purchased a truck in Texas a few years ago and have had nothing but trouble. When we purchased this truck we were told the truck had never been involved in an accident (Carfax genereated statement). As of yesterday we found out by a car dealer when we tried to trade the truck in, that the vehicle had been totaled in 2004 and had a clause on the title stating it must be approved my a professional before an owner could purchase the truck. Needless to say that NEVER happened. We have had continuous problems with the vehicle costing thousands of dollars. What is our legal recourse without having to suffer repossession. There is currently 6000 dollars worth of repairs to the truck we simply cannot afford to do anymore.

I was recently approach by a sales person in the mall and explained to me about a 2011 ford edge car at the dealership was only $3100 out the door. Could not believe , so we met there and the Sales manager along with another sales rep met and the Gentlemen. After test driving this car I fell in love and was so excited. This car was brand new with 18 miles. I just Knew it was too good to be true, I started asking questions; so what's the catch? nothing for $3100.00 this car $42,000.00 is yours. 2. Well who pays the balance of the car price. The gentlemen replies my Shareholders are paying the balance and that you will own the car. 3. What about the tax and tile. You will get a electronic title and your tag will be sent by the DMV. I then turned to the General manager, he was adamant the legitimacy of the purchase and this was not a scam. Well who gives away a car and why aren't there many people purchasing these cars. Should I pursue this venture or run away? Electronic titles are only issued when there is lean?

Leasing Company's receipt is $800 less than I paid for the car

I recently purchased my previously leased car. I paid the exact price given. I received the pink slip with an unitemized "receipt" with a figure that is $800 less than what they asked me for, and what I paid. I have asked, faxed a request with a copy of my check, called customer service, been to the bank that owns the leasing company now three times and so far have only gotten promises that I will get an itemized CORRECT receipt. I have waited over a month and have still not gotten a receipt. Even the people at the bank that owns the leasing company think it is crazy I can't get a correct, itemized receipt.

I realize that i will pay less taxes on a price that is $800 less than I paid, but this doesn't feel right. I want an itemized, correct receipt for the actual price they requested, including their "fees".

It seems to me that if they continue to refuse to give me an itemized receipt showing my final purchase price, including their fees, I am due the $808. difference.

CALIFORNIA LIEN SALE CAR PRCHASED FROM TOW YARD

Hello. Last night (August 16, @ 6:00PM) I bought a USED CAR from a towing company in Oakland, CA.....I had seen the car listed on Craigslist. An employee of the company showed the car to me, told me the MINOR things it may need, then drove me(AND my brother) around the corner in the car as my "test drive". Not hearing or smelling or seeing anything WRONG with the car after this short ride (note: car did not go more that 15 or 20 mph during this ride) , I went ahead and purchased it. It is a 1993 Nissan Maxima, with 193,000 miles, for which I paid the man $900.00 CASH. This all occured when the towing co. was closing or closed. I drove the vehicle away as the seller drove away. I went approx. 3 blocks to a gas station to clean the widshield that was covered with dust/dirt with my brother following in his car. When I stopped at the pump, my brother ran over saying the car was blowing BLACK SOOTY SMOKE from the tail pipe all the way from the tow yard!! And couldn't I smell it or see it?!?! I had smelled exhaust, but figured it hadn't ran in a while & that was why....I couldn't turn off the car, as the battery was NOT fully charged, so pressed the gas a few times as my brother thought it may just need blown out....all this did was make it smoke WORSE. My brother owns a Nissan Maxima also, and told me at that point the black smoke was NOT a good sign, it would NOT pass smog, and in his opinion, would NOT make it 52 miles to our home in Manteca, Ca. After standing there with my eyes burning from the smoke I agreed. The tow yard was CLOSED. I drove the car back to the yard and parked it where I had just pulled out of an hour earlier, locked the doors, kept the key, and went home. IS THERE A 72 HOUR LAW THAT LETS ME GET MY MONEY BACK FOR THIS CAR THAT WAS MISREPRESENTED TO ME AS HAVING ONLY VERY MINOR ISSUES??? Used Car Fraud

We purchased a 1999 used vehicle in Monroe County, PA. This county does NOT require Emmissions Testing. The county we live in, Northmapton, PA does require emissions testing. We questioned the looks of the muffler when we bought the car. We were told it was fine. We were told a Safety Inspection was done. We have found out that we need an entire exhaust system and a front axle...completely dry and could lock up at any minute. I have called numerous times to keep the dealer updated. We have two mechanics look at it with the same findings. The owner hung up on me the last time. I just called this morning asking for the mechanics name, when was the vehicle Safety Check done, and I could not get an answer from the gentleman. He said Joanne needed to answer these type of questions and he would have her get back to me, that she wasn't in yet. We feel this dealership knew of this problem and have done nothing to meet us even a 1/4 of the way. Can I file a small claims suit? Is it legal that they sold us a car I am sure they knew of these two major problems?

What state did your sister purchase the car from? In most cases a dealer owns the financing after 10 days. If they did not secure the financing within the 10 days...they own the contract and your sister will just need to pay them.

I feel time is of the essence here. I purchased a Certified Pre owned vehicle. I took a test drive and liked it. I bought the extended warranty. 3,000.00. Pre certified at this dealer goes through a 152 point inspection and a check on carfax. Tires are to be inspected during this inspection. When I drove the car on the highway. It started to shake a lot. I called and they said bring it in. I started to do some more investigating on my own. The car fax that was not given to me until after I signed said "Fleet Vehicle". They told me it was a corporate car. I called the owner/dealership listed on the Car Fax and indeed it was a rental vehicle. Also, They did take a post dated check for downpayment. I feel that the car is unsafe and that I cannot trust thier service. I am highly upset. Also there is a 589.00 doc fee with the warranty that was not disclosed. I did sign the papers, but the date of the down payment is not on one document? And they did not tell me that it was a rental, furthermore, I need 4 new tires at my expense. I am the owner of this car for three days now. Is there any way they have to take this back?

The dealership advertises and tells me the mileage is 29K-- which is also on car's dash.

Carfax says 40K+

Is this a clear case of odometer tampering? Or what??

Warranty status changed

I have a contract with my dealership that says there is a 7year/100k mile warranty bumper to bumper. About a month after my purchase of the vehicle I got a letter in the mail stating there was a change to my warranty and that it's not going to expire in 2018 but instead in 2014.

So my thing is, during the purchase process, I asked several times if they were sure that the terms of the warranty were correct, they promptly replied "yes, they're required for Certified Pre-Owned, which is required for your financing."

I purchased a used truck this past Sunday, I did not have the down payment but I agreed to pay 4200 down, two checks (2000 and 2200) dated for that day, but agreed not to be cashed for 3 days and then 2 weeks. Since then I have realized that I won't be able to get the money together for the second check. I also did some research and found that they ripped me off on the truck. He does have a judgement on his record from 6 years ago and they were well aware of that when we signed the contract. They had even approved his credit and approved us for the loan knowing that information. I was recently contacted by the dealer saying that the loan had been reconsidered and that I had to find another cosigner for the next 6-8 months in order to keep the car. In the case that I do not find another cosigner, I have to take the new car back. We have had ownership of the car since July 25, 2011 so it doesnt make sense as to why they are backing out all of a sudden. Any information back would be appreciated.

get off the computer and contact a lawyer in your state. many state's consumer protection laws provide for attorney's fees which causes a lot of attorneys to take your case on a contingency (you don't pay unless you win). You also need to contact your state's attorney general's office and report what's happened.

Hi, I just bought a car, I did realize until I got home that the contract had insurance that and a very expensive theft protection that I did not want included. I have being told I can not change the deal by the dealership and must pay for the added contract items. I also was told that I needed to write two (2) post dated checks to cover my down payment. The "closer" told me to tell the bank when they called that I put $5000 cash down, I did not of course. I put $1000 down and was to write 2 checks for $2000 each that were to be post dated checks, the checks somehow never got written. Do I have to write the checks now that the bank has the contract and thinks I gave them $5000 in cash as stated by me when they called and is written in the contract; also does the dealership have the right to repossess the car if I do not write them the checks? What are options here...thanks!

Just Purchased a new car

I feel like a complete idoit. This past weekend I just purchased a car from the local nissan dealership.

I found the car on the Internet, listed at 21,999 with an internet price of 16,999. I went in and worked with the salesman for a very long time for an agreed (monthly payment). At the time, it didn't dawn on me to negotiate the actual price of the car, the focus was on the monthly payment.

It seemed that everything moved quickly and next thing you know I was signing the papers. When I got home I realized that the price of the car was 20,624 not the 16,999 that it was listed on the their webpage.

Is there anything I can do?

I understand I signed the contracts, and I am at fault for not reading what I signed, but I feel what they did is very unethical and I read on the ucan.org page it is illegal, or does this not apply to internet advertised prices?

if you financed the car, you should have received a Truth in Lending Statement (TILA). if you diid not, you have one year to sue on that violation of federal law. call a lawyer today, you may be able to get out of the deal completely

Check with your state on laws regarding sales price vs. advertised price.

And never ever negotiate a monthly payment; this is how car dealers figure out how to get you to pay the maximum amount for a vehicle that they would have willingly sold to you for much less.

At home, find out what the car you want should be able to be purchased for. This is usually several hundred dollars above the invoice price (after subtracting any rebates, of course), depending on the popularity of the model.

Then figure out what your monthly payment should be, at different interest levels. NEVER tell the dealer what payment you would be comfortable with!

Okay, it's getting late and my advice is the same for everyone.
Contact an attorney who practices consumer law in your state. Tell the firm
that you believe you are a victim of "auto sale fraud". Make a report to your
state's attorney general's office.
Most states have extensive laws that protect consumers in auto sales. Access them!

Rewritten Contract

Hi, I recently signed a contract and drove off a Honda dealership with the vehicle that I agreed to purchase. About 7 days later the dealership called me back and said that I had not been approved for the entire fincance amount and woukd have to pay $2100 down and would have to remove the gap insurance and extended warranty in order for me to qualify in addition to making the loan a five year loan which meant the montly payment would be higher. It has not been 10 days yet and I would like to know if I can just return the vehicle and avoid any deals that I do not want? I'm sure they are going to find a way to get the loan approved but they will most likely want to redo the contract and remove gap, which I'm not willing to purchase the vehicle without. If they do get the deal approved but have to remove gap and/or change the length of the loan which would change my monthly payment, do I have to agree and sign the new contract? Or can I just return the vehicle even if they get an approval but want to make changes that I don't agree to? Am I obligated to agree to any changes they make to the contract after 10 days? Can I be penalized if I do not sign a new contract and return the vehicle? Will it show on my credit report?

Gap Insurance

I'd just like to add that GAP insurance is most likely available through your current insurance on a new vehicle for a fraction of what the car dealer will sell it to you for. I think mine is something like $20 a year on top of my normal policy. Check with your insurance company!

If dealer cannot honor original contract... then deal is void

Doesn't really matter if the sale was 10 or 100 days ago... if the dealer cannot honor every financing stipulation you agreed to in the original contract, then the deal is void and you do not own the vehicle unless you "resign"... which is what they want you to do. Your credit cannot be damaged since financing is not in place. They will pressure and "bully" you to resign acting like the deal is still valid and you can't return it... but that's not the case. Call the dealership manager ASAP and tell them unless the original contract is honored, the vehicle will be returned immediately. Chances are good at that point they will honor the original deal since the last thing they want is the vehicle back... even if they lose money on the deal after the fact. You've got to play "hardball" with these types of folks and hold your ground. Many people do not and "give in" to the pressure which is why dealerships are able to get away with such practices.

Thanks for your help. I originally signed a 7 year loan which included gap coverage and an extended warranty since the vehicle is used. They weren't able to get that loan approved and want an additional $2100 down payment along with removing the warranty and gap and shortening the loan length which would raise my monthly payment. I'm not willing to agree to any of those modifications but the manager said that I would just have to wait and cannot return the vehicle until they said so meanwhile they worked on getting something approved. He said in case they couldn't work out the deal, they would call me back to return the vehicle. At this point I no longer want to deal with them and would like to return the vehicle, can I do so? I'm in California by the way.

Sure!

Whatever new financing terms they come up with is going to require a re-sign by you to be put in place. Doesn't do them any good to work out new financing if you're ultimately going to refuse. Just let them know you will not re-sign and want to return the vehicle immediately. The only way they can hold you to the vehicle is if they enforce the original contract. It sounds like they're halfway agreeable in having you return the vehicle... so go ahead and push them hard to get it done. Good luck!

Keep in mind...

The consumer affairs laws mentioned at the start of this page only apply to California. You'll need to do some further internet research to see how Minnesota law stands on this issue. I'm going to guess that Minnesota allows this practice since many states do not even come close to the consumer protection laws that California has... but it's worth checking into. Good luck!

1 week $2,000 in repairs????

Hi, I hope some one has some good advice for me. I live in Minnesota and recently bought a used durango. I have had it 1 week and am having a major problem with the cooling sysytem..head gaskets etc. I am hoping the used car lot will help me get this stuff fixed. I just want to have some leverage when I go in there. The car was listed at $6,999 and I had a trade that I was upside down on. So the dealer kindly upped the price of the car to $8,999 and added $2,000 to my trade to make it look better to the bank. I guess I am reading from a tax standpoint it is becuase I am paying more than sticker price and thus paying for taxes, intrest, etc. I just want to have some ammunition when I go to the dealer to beg them to fix my lemon!

your state may have a auto warranty law or lemon law that allows you to recover the amount you paid on the vehicle. call a lawyer and report the dealer to your state's attorney general

Two different agreements

In my contract, it says that I have no down payment. But I have a separate piece of paper stating I can make payments to equal a down payment of 2000 dollars. Also, my contract states that I only paid 80 dollars for registration. But the dealership is not letting me have my tags unless I pay them 168 dollars. Is there anything I can do? And does the not having a downpayment on the contract void anything? I'm a US Marine looking for help.

Dealer tries to cancel Bill of Sale

A dealer recently contacted me and I agreed to sell my car to them outright - no trade-up. We signed a Bill of Sale with witnesses (not notarized) and they took possession of my vehicle immediately. I cancelled its insurance and am waiting for the check to arrive. Since my next loan payment was coming up without resolution, I contacted the dealer numerous times and was assured not to worry about the loan payment and my payoff would come shortly. Now, over 3 weeks after selling my car, I receive a call telling me that they have decided not to purchase the car. No explanation. I do not want the car back and feel I have a valid Sale - no disclaimer on conditions or subsequent findings (the car is in good condition and was inspected by them prior to their offer). Any suggestions or advice on how to force the dealer to honor the contract? Thanks

Unless something happened to materially change the contract, they cannot back out.

Imagine if everyone who bought a car from them and had second thoughts could simply back out; they'd be hurting. Contracts exist for a reason, and they need to honor theirs... assuming there is no language in there that allows them to back out, of course.

Spot program

Hi Hal, So I'm a good person with a great Job, but I have BAD credit. I've been in the market for a used car mainly something I could finance comfortably to build my credit to better numbers. I found a dealer and I got denied for a finance loan for the particular vehicle I wanted. However the dealership offers to put me in what they call a "Spot Program". As it was explained to me I would finance one of their cheaper cars on their lot and then after making on-time monthly payments for 3-4 months I'm automatically eligible to come back and take the original vehicle I desired with just a slight increase to my monthly payment plan. They guarantee the car that I want will be on their lot because they will put it in storage until the probation period ends. What do you think? Does this sound like a scam?

Get it in writing. Every single detail. Get it all in writing, from the number of payments you must make before "upgrading", to the VIN number and exact mileage of the vehicle you will be upgrading to.

Make sure it lists any charges that will be incurred, and make sure it says there will be no additional costs upon the changeover.

Sounds risky, but if you get every detail in writing, it may be legit.

i bought a car from a dealership who has a pretty good reputation. But i was recently sold i belive i 1996 chevy trail blazer that was suppose to be in great working condition and had just past inspection. First within a day i realized that my gas guage was not working properly so i had it fixed under the warranty. Within a couple days, after i had gotten the car back, my engine started stauling or shutting off so to speak while driving. sometimes it wouldnt even start right away. But it was an issue that i overlooked for a little saying that not having a car would be a huge obstacle to overcome given my extremely busy schedule. Eventually it got worse and not only would the engine stop working, but the break wouldnt work. So my car would just continue moving so i slammed on the e break. after this even occurred i scheduled an appointment to have my car looked at, two days before my appointment. i was driving and the same thing occured except this time i hit the car in front of me. Can i sue the car dealership and would they be more willing to settle simply out of the fact that they wouldnt want to have their reputation tarnished.

Auto Loan fraud?

I have a friend who bought a used vehicle from a used vehicle dealer. She thought the loan the dealer arranged was with a bank. She set up automatic payments to pay the loan, but due to a clerical error she underpaid her first payment by $135. Her car was repossessed, and the lender won't let her make good. She's out the $3000 down payment and has no car.

Does she have any legal recourse?

If you bought the vehicle AS IS, you bought it exactly that way: AS IS.

NEVER NEVER buy a vehicle AS IS. No matter what is wrong with it, you are agreeing to buy it with all it's faults. There is a reason they stipulate that you are buying it AS IS; because it has serious flaws and likely is virtually worthless.

"Estimate"

Hi,

I live in Sacramento, CA. I bought a vehicle in April 9, 2011, renewal was in May 2011, and received a call from the deal I bought the vehicle from in July 2011, stating that I had to reimburse them back $260.01 because they paid for my vehicle registration.

I asked why I was responsible for reimbursing them when they had plenty of time to notify the CA DMV that there had been a new owner? He said that on the Finance Contract that I signed, I only paid $4.99 for Registration, Transfers Titling Fee and the amount was higher than "Estimated" $4.99 (Estimated was typed in).

The dealer further explained that the CA DMV expects the dealer to pay for the registration first then collect the reimbursement from the consumer, thus, the bill of $260.01.

So, the question is, Do I have to reimburse the dealer back for the registration fee or am I being scammed?

Was the term "Estimated" added to their copy of the contract, or just on yours? If they added it just to theirs, they are committing fraud. Otherwise, you may be out of luck.

I need to know if I buy a car from a car lot, and I am told the car is a 6 cylinder" But find out later the car is a cheaper 4 cylinder. Does that void the contract? Since I paid more then a 4 cylinder is worth and the contract states it is a 6 Cylinder.

I got a used car from a dealer in Penna and he sold my other car to someone else. I never signed the title of my old car to him and someone else signed my name. is this legal?

If you can legitimately void

If you can legitimately void your sale contract, they either have to return your vehicle or pay you an agreed amount. If that doesn't work, call the police and report that the dealership has stolen your vehicle. You will be able to prove that you did not sign the title, and the dealership doesn't want to get in trouble for forging titles.

Hello Hal, I have a question. I purchased a 2004 trailblazer from a second chance dealership here in indiana..I supposedly traded it in for 1996 chevy blazer. The trail blazer was supposedly 14,000..they told me they would take my truck and knock 2000 off the purchase price. however when i received m contract, it didnt indicate a trade of 2000..I still put a down payment of 1200.00 cash plus my truck...they then came by ny home and ask me to sign a bill of sale..this was about 2 weeks later. The sales person first told me thathe was giving the 1996 blazer to his son..but when they came to my home to sign a bill of sale they said the truck had been given to a Mar chamberlian in another state. They offererd to pay me 200.00 cash for 10 months..so far ive received two payments...now they said theyre not paying anymore...I never signed a bill of sale with the buyer..does she have to be present..do it have to be notarized/ should I get me a lawye and pursue criminal or civil damages?

adding up tax and lisence was 4,300 & 300 respectively
when it came to the cost of the vehicle in finance it was over 63,000
the dealer told us he added up the cost (this is not on the bottom line this was on the uper first 3 lines of the form)
he told us he added up our trade in which is part of the cost of the vehicle as well as the lisence and tax
there was no where on the paper the sale price of 48500

My husband and I just bought a 2004 saturn vue in san antonio texas and have run into some problems with our a/c. When we purchased the car we noticed a note on the wall stating that the '04 vue needed a/c repair. I asked about it and they said oh it works great! Runs ice cold. While talking about the 30 day warranty for only the engine and transmission I asked if the a/c could be added too. They talked it over with the boss and said sure. Well 2 days later we are taking it back after a huge run around! They loaned him a bearly running truck in the mean time and tell my husband it will be ready the next day. So the next day he calls, no one answers, so getting fed up he starts heading over there. The truck breaks down. Finally he gets someone to answer only to tell him the vue has not been worked on. They send some one out to work on the truck. He still has the truck and is reassured that the vue will be brought to his work today by noon. Never showed up. So he called and the guy mistakenly answers and doesn't realize. He is talking to the machanic about the guy calling again crying about the saturn. The machanic says he has all the parts but it will be a while. Then he goes to talk to his boss and the boss said to just give him (my husband) back the way it is and said its fixed. My husband and I are furious. We put a $3,500 down payment on the vehicle one week ago today. Is there any way to get our money back and walk away from this mess? Is there someone we can report them to?

Purchesed Vehible 7/7/11 2001 Nissan Xxterra and 1000.00 Down Payment . Test drive the vhicle before purchase. The A/C Worked perfec it was very Cold. I signed the papers and took the vehicle home. The nest morning the vehicle was blowing hot air, I contacted the salesman and he ask to bring it in for repar on the 7/08/11. My selesman call me 7/26/11 to picup the vehicle. I returned the company car and pick up my vehicle. on the4 way home I notice the A/C was barely cooling the vehicle. I ad a few herrand to run the next two days. during the two days there is some oil odor comming out the vents. 11/28/11 Call the saleman and he said take it to the service department and let them fix it. One of my questions is is this a scam? and they have ad this vehicle for over 3 weeks, and soon the payments will be due and they still avent fix the A/C?

PA inspection

I recently bough a 01 Volkswagen from a buy here pay here dealer. When I bought the car the salesman told me the car had just passed inspection in PA and he was 100% sure it will pass in DE because and I quote him"PA inspection is a lot more complex due to them taking off tires checking under the hood Ext.". The salesman did say I could not take the car yet because he hadn't taking it through DE inspection yet. I told him that I could take it through inspection then bring him the papers on the same day. The next day after taking the car home the check engine light came on and the car did not pass inspection. I brought the inspection papers to the dealer and the owner said that I would have toand I quote "leave the car overnight with him so he can work his magic to turn it off". He then told his son to take the computer and plug it to my car to see why the check engine light came on. He went and came and told his dad he couldn't turn it off. So I asked him was he going to fix what was wrong with the car and he said yes. We made arrangements so I can drop my car off in the weekend. When I left the dealer I took the liberty of taking the car to my stepfathers shop and see if I was able to get a diagnosis and he plugged a computer similar to the one the salesmans son had but bigger and there was a few things wrong with the car. I told my stepfather the story with the salesman and my dad showed me a trick salesman do to care with the computer they plugged to my car, my dad pressed three buttons on the computer and the light came off......
I passed the car through inspection and it passed. I confronted the dealer and he said the car was fine when he sold it to me.... so I let it go
A month went by and I had to replace the valve cover gadgets because a lot of oil was leaking. The mechanic pointed out some markings on the valve cover that may have been from the PA inspection. He told me the car had been like that before the inspection....

Can I sue him for this....

used car nightmare

Purchased a used Jeep, brought the vechile home and the next day would not start. Following day started went to the store came out would not start, after numerous attempts finally started. Next morning would not start, again tried and finally started.
The dealership owner took the Jeep and replaced the battery. I wanted to return the car, buy another one, was refused.
Here is the strange part, paperwork says I put $1800 down I did not. Can I ask the finance company to cancel the contract?

New car loan (Florida)

I purchased an used Jeep from a local dealer and went in with an online approval which they later said would not be enough for the vehicle I wanted so they arranged financing through Americredit and asked for 3k down. I was not able to come up with this right away so they offered to take installments and asked me to sign a check for the full amount (promising not to cash).

Fortunately the reasons for me purchasing the car (going through a separation with my wife) are no longer present and we are back together. Now I owe two more payments of 1k each and a the fianance company states they approved my loan and next payment due is in a week.

I cant afford these figures now, what can happen if I decide to just return the vehicle?

I bought a vehicle from a dealership at the end of january 20011, since then i have had to put new power steering rack and pinion, new tires on the front and now im being told that the bearings on the tie rod are shot. i put the new tires on a month ago and they are completely bald on the inside of both..i was also told that the right front rim was bent on the vehicle. i have taken it to 3 auto shops and they all believe that it has been in a wreck before..if it has been it has not been disclosed to me. I cant make my vehicle payments becasue i have to constantly put money into this vehicle which is aq 2008 dodge nitro sxt 4x4. i dont even want the vehicle anymore. i feel i was scammed into buying a newer model vehicle thaqt has been damaged before and wasnt told to the car dealership that bought it and in part sold to me afterwards. is there anything i can do to get rid of this vehicle and get my downpayment back? is there some kind of lemon law in michigan which is where i purchased the vehicle?

Bought vehicle and can't make payments

To answer your question simply, no. There is no lemon law on used vehicles in most all states and some states there is a lemon law but there are extenuating circumstances that must apply; and in your case, you do not qualify. Every person looking at a new or used vehicle has the option to take it to a private mechanic and have it thoroughly inspected. If you failed to do so, you can not go back on the dealership or the finance company. Secondly, you must still make your payments even if the vehicle is not running. What people don't understand is when you finance a vehicle, you no longer have relations with the dealership unless it's for warranty purposes. The finance company has already paid the dealership for your vehicle and they are who you owe. Your contract does not state that you will make the payments so long as the vehicle is running. It states that you will pay X amount of dollars in X amount of time, no matter what. If you were to stop making payments, you are subject to repossession followed by collection proceedings which will include a civil judgement. The only option it seems you have at this point is to trade the vehicle with another dealership and purchase something else. Dealerships are always offering promotions where they take in your trade even if you still owe so that you buy from them. This may not be the most financially sound option but it's better than being left stranded and paying for a vehicle that is constantly costing you money.

Used car under warranty, inspection passed...

The sway bars and front axel were broken after we purchased the used vehicle under warranty and passed inspection. The vehicle made noise immediately after purchasing, and took it in to be looked at about 2 weeks later. We were told the sway bars and front axel was broken. We had to pay a $75.00 co-pay to have it repaired, and the warranty company paid the rest. But, my question is, shouldn't that have been noticed in the inspection? And why did we have to pay a warranty co-pay? It seems to me, inspection was not performed, otherwise they would have caught onto that.

Second, we purchased another car, at first it said warranty, 90 days. The dealer took the warranty off the car, and told us for the price of the car, he was not going to honor the warranty. Once again, this car is having serious problems; stearing wheel locking up, all electrical does not work; windows, dash lights etc... The dealer told us to take it to the auto mechanic to have it looked at, and have the mechanic call him. I certainly hope he pays for anything wrong with the car, as it has problems since the day of purchase, and it almost cost my daughters life, as she come close to hitting a tree, while the steering wheel locked up on her.

any reputable dealer will warranty every car they sell with a 30 day warranty, except for cars specifically sold "AS IS". If you buy a car listed as "AS IS," you already KNOW there is something wrong with it. You only buy those for parts or if you know how to fix them!

Bought new Infiniti - Bumpers not factory paint!

Hello, I purchased a new Infiniti. I am coming up on a year owning it. I just found out that both front and rear bumpers have been repainted. I asked dealship way and what happened to the car to have bumpers repainted. So far nobody is taking blame for the repaint.
Did they have a legal abbligation to disclose the paint and/or any other damages to me before i purchased the vehicle?
If so what can I do?
The vehicle cost me $40,000. And assuming all they did was have the bumpers repainted that cost is over $1100.00.
I was told by the dealership that they would do nothing and that it would have to go through infiniti warrenty since they did not have the bumpers paint. Yet within 2 business days they gave approval to have repainted. I am concerned they are hidding something. Why would the dealer pay for something they knew nothing about.

I have been fighting with Suzuki motors for over a month now because they will not fullfil their warranty coverage of the engine of my 2008 xl7 car. The car has only 54,000 and had apparently been consuming too much oil that went unnoticed by me. When the car failed me I took it to the dealership and they indicated that they found chards of metal in the oil pan. At that point the dealership told me and my husband that Suzuki would not autorize the repairs unless they could determine that there had not been neglect on our part but they required us autorize $500 worth of tear down work; they were looking for sludge. Upon opening the engine it showed that there was none but one side of it was dry which had resulting in a streched timing belt. Still, Suzuki indicated that the results were inconclusive and wanted us to authorize more tear down cost: $1,700, just so that they could make a better assessment. We refused and told the dealer that they were not to touch the car anymore. Suzuki has made no attemp to contact us. The car has been sitting at the dealearship lot since 06.29.2011. We have provided all receipts for the regular oil changes performed in the car as well of other receipts for repairs to other unrelated problems which Suzuki indicated were not covered under warranty anymore and that were done at our local mechanic. Still Suzuki and us are at a stalemate. Because of this, I am seriously considering giving the car back to them and discontinue the $446 per month montly payment. In my head, I committed thru a loan to buy a car with the expectation of ownership under the believe that I was purchasing a very reliable car to last me for several years, after all is my 4th Suzuki; I trusted their advertised warranty although I never expected to have to use it given my experience with the previous cars I've owned; but, now when I need the warranty the most, they decide they will not honor it? If they are not willing to do their part, why should I? I want to give the car back. I have enjoyed perfect credit, build it from scratch upon arriving to this country 18 years ago, but with my husband unemployed and recently diagnosted with a serius illness, I don't need this additional stressor in my life. I rather take a hit on the credit at this point i think, if nothing else is there for me to do. I would appreciate your opinion on this matter. Thank you very much

Contact Suzuki headquarters and your regional Suzuki manager.

Write letters detailing the situation to them, and send them certified.

If you have records of oil changes being conducted according to manufacturer recommended intervals, it seems like Suzuki will have to cover this.

Trade-In

I recently traded a 2010 Colorado for a 2011 Mazda. I looked up what I owed on the leinholders (Ally's) website. The cost was $17,761 and some change. They gave me $17,350 for my trade. After signing all my paperwork and having the car for 2 days now, the dealership called back and said that they had contacted Ally and that the balance on my trade was more than what the website said, what can or should I do? I don't want to have to pay them extra money that I don't have to.

Find out the day the dealership claims to have made payment, and ask Ally what the payoff amount would have been on that day.

As it is, the payoff was $311 higher than the trade allowance, but those numbers mean nothing until you find out how much the dealer actually paid the bank. They could be lying to you (shock! surprise!).

Payment Date

I bought a van yesterday from a dealership. The sales rep told me he could give me 2 months before the first payment which I shouldve pushed for 3 months and he said I would have to bring in $1000 for the downpayment in 30-45 days. Not realizing until now because I was tired and ready to go when I signed the paper work in the finance department that the first payment is due September 1, 2011. I already payed my July payment for the car I traded in so I dont' have that money to go towards the $1000 and besides 2 months is September 23rd not September 1 why would the finance person do that? Now that I am out of the dealership and able to think I realize I won't have the down payment until October nor will I be able to pay the first monthly payment until October. Can I get my trade in back, Can they change the contract of the first payment to October 23, can I pay the down payment in October?

2nd chance finance In

We are currently In 3 year contact. With a 2nd chance finance company. We have paid 1 full year on time. I lost my job. We have NOT been 30 days late. We have been 15 or 20 days, but not 30. However the finance company calls us every day and tell us they are going to repo our truck. Can they legally do this? We are feeling like we are being bullied here! Help please. If they can't do this to is, what can we tell them to may them stop harrassing us?

Is it a scam....

My mom has recently been financed for a car that she is getting for me to get back and forth to college. I have had this car about 3 weeks at least.. Unfortunetly we have been getting letters that my moms credit was not approved but instead was declined because of excessive obligations and insufficient income. The dealership has contacted my mom to let her know that tomorrow she could come back and get a newer car but i couldnt keep the 2006 Kia Spectra because she could only be financed for a new car and not a used. That sounds weird to me. But I have called the salesperson at the dealership and talked to him and he is very nice. He has informed me that come saturday I can leave off of the carlot with a new car instead of a used car. Is this a problem? Im young and dont know anything about this credit stuff and getting declined by a bank to get a loan. Is this also a scam or is their possibly a way that i am getting a new and better car.

Banks will sometimes make loans on new or at least newer vehicle as opposed to older used vehicles because of the warrantys on new cars. If you purchased an older vehicle and were to have mechenical problems with it, you might not be able to afford to get it fixed leaving either you or the bank with a broken down car. However you are under no obligation to purchase a new car and can just geet your down payment back. You can also try to arrange financing through your own bank or credit union before returning to the dealership.
